Improper isolation and restraint measures, poorly heated rooms, violation of privacy… The general controller of places of deprivation of liberty is calling for urgent measures in the face of the treatment inflicted in a mental health center in Lens, in Pas-de-France. -Calais.

In a report made public on Tuesday, the lack of overall management, the non-respect of the law and the lack of training of the staff of the Jean-Baptiste-Pussin mental health center in Lens are pinpointed, leading to dysfunctions "of a particularly serious and old" and infringing the fundamental rights of individuals.

No reflection on the special needs of minors

According to this report, “adults and minors are subject to arbitrary isolation and restraint measures implemented in appalling conditions”.

In the isolation rooms, "particularly poorly heated", the patient's privacy is not respected because "he is exposed to everyone's view (…) by surveillance camera screens located in the nursing station and visible from the hallway,” the report said.

According to the law, any hospitalization under duress can be appealed, but patients are not sufficiently informed of their rights and do not attend hearings before the judge of freedoms and detention.

The risk of running away is also advanced.

, however, judges the report.

In a letter sent in response, the Keeper of the Seals, Eric Dupond-Moretti, announced his intention to issue "an instruction" to "clarify the conditions for the balance to be found between the risk of the patient running away and the importance of appearance at the hearing”.

In addition, he "deeply regrets" that a court decision to lift a hospitalization measure "was not immediately implemented".
