In response to a request for information disclosure of negotiation records regarding state-owned land transactions with Moritomo Gakuen, the Ministry of Finance ordered compensation of 330,000 yen in a trial over the fact that the document that actually existed was not disclosed, making the government's response illegal. The decision was finalized.

Five years ago, the government did not disclose the record of negotiations with Moritomo Gakuen regarding state-owned land because it was "already abandoned" in response to a request for information disclosure made by a university professor in Kobe City.

However, after that, it became clear that some documents were intentionally abandoned in line with the Diet response from the former director of the Finance Bureau of the Ministry of Finance, and some documents were kept by the staff, and the university professor sent the government to the country. I have filed a lawsuit seeking compensation of 11 million yen.

The Osaka District Court of the first instance said, "We have discarded the records with an extremely inappropriate motivation to minimize the materials that could lead to questions in the Diet, and intentionally made the remaining documents undisclosed. Illegal acts "It's obvious and quite malicious," he ordered the government to compensate for 330,000 yen, and the second-instance Osaka High Court made the same decision.

A university professor appealed because he did not allow the amount of compensation to be increased.

Regarding this, Saburo Tokura, the judge of the Supreme Court's Third Small Court, decided to dismiss the appeal by the 25th, and the ruling that ordered compensation was finalized, making the state's response illegal.
