Banyuetan reporter's investigation found that some of these "street photos" have gone astray, some people wantonly secretly photographed private parts, and sold "soft porn" photos on websites and forums. A new type of "urban psoriasis".

  Recently, a Weibo blogger, @NI Spicy Nina, posted a video with the topic #Your photos taken on the street were sold#. The video revealed a lot of inside information about street shooting and candid photography websites.

The reporter from Banyuetan contacted @NI Spicy Nina. The blogger introduced that she received a private message from a netizen in 2017, saying that her skirt had been photographed and posted on a street photography website called "Sediq".

  After receiving the private message, @的火nina found the website and found that there were not only the above-mentioned photos of the netizens' skirts when they were shopping with friends in Sanlitun, Chaoyang District, Beijing, but also photos of some women who were secretly photographed on the road.

These photos also include the moment when a woman gets off a bicycle and disappears, and many of the group photos have over 10,000 views.

  The website has not been blocked after the website was reported dozens of times.

Not long ago, @的火nina discovered that another blogger who exposed various secret photography methods was banned. When shopping in Sanlitun, he still saw many secret photographers with "long guns and short cannons", so he decided to publish a video to expose the incident.

  Banyuetan reporters found online that most of these candid photography sites implement a paid membership system, with different price points such as 99 yuan, 288 yuan, and 480 yuan.

If the original photo post posted by the candid shooter is set as the essence post, he can get 1,000 yuan, and he can get 600 yuan for moving the essence post.

Also, these sites generally have alternate URLs, and if the site is blocked, they will transfer the web address.

In addition to websites, some micro-shops also publicly sell candid photos.

  A large number of websites rely on candid photos to "attract attention"

  Banyuetan’s investigation found that candid websites that sell private photos of women are not uncommon, and they are very easy to find.

In the video, @嗗nina mentioned that when you search for street photography websites directly in the browser, various candid photography websites will pop up.

She told Banyuetan reporters that after the exposure and reporting, these websites can no longer be searched in this form, but you can still enter directly by searching for specific website names.

  A reporter from Banyuetan searched the multiple websites exposed on Weibo by @嗗nina, and found that most websites can not only be accessed directly in the browser, but also many websites are related to each other. After clicking on a website, you can directly enter more websites.

After searching for and entering a website, whether you click "Enter Site" or "Leave Site", you will enter another website.

The homepage is divided into multiple sections such as SLR street photography, street photography, and annual membership boutique area. On the homepage, you can see a large number of candid photos, and each group of photos is equipped with "sexy leopard print beauty" to attract attention. title.

  As @的火nina said in the video, the photos on this type of website are not only candidly taken on the street, but even some candidly taken in private places. Candid photography not only occurs in some well-known "streets" such as Sanlitun in Beijing and Taikoo Li in Chengdu. Shooting points" also occurs in many everyday corners that are difficult to detect.

By browsing and observing the photos on the candid website, reporter Banyuetan found that the scenes were taken in streets, shops, parks, hospitals and even the interior of residential buildings.

  However, such behaviors have not been effectively supervised, and some of the people who were secretly photographed could only passively endure them.

In February last year, Nanjing girl Xiao Fang took a photo with three friends in the Xiaoxihu community.

When Xiao Fang was sitting and taking pictures in a suit and skirt, a friend found a man with a DSLR camera secretly taking pictures of Xiao Fang two or three meters away. Another friend immediately stepped forward to ask the man to delete the photo and watched the man delete it. Let it go after the photo is taken.

And half an hour later, Xiaofang found out again that a man was shooting her with a mobile phone. When Xiaofang's friend came up to ask if the man was filming Xiaofang, he was insulted by the male companion.

 Don't let urban "psoriasis" become synonymous with fashion

  "Suddenly photographing and selling other people's information, suspected of violating privacy rights, will face administrative responsibility, and those suspected of committing crimes will also be held criminally responsible." A legal person pointed out that in the face of such incidents, the infringed can communicate with infringing websites, candid photography If the negotiation fails, you can take a civil lawsuit and request the court to order the infringing party to stop the infringement, compensate the loss, eliminate the impact, restore the reputation, make an apology, etc.

In addition, it is also possible to report the problem to the public security organ, and the public security organ will impose public security management penalties and investigate the administrative responsibility of the infringer.

  Zhang Li, an associate professor at the Law School of China University of Political Science and Law, pointed out that the Civil Code has a more specific definition of personal privacy, which mainly includes the tranquility of private life, private space, private activities, and private information of natural persons.

Therefore, when judging whether it is illegal to take a photo that the public considers to be a private part, one can first determine that the private part is private based on the provisions of the Civil Code itself, and then connect it to the provisions of the Public Security Administration Punishment Law to make corresponding penalties.

  "To a large extent, this type of candid photography website will constitute the subject of 'spreading other people's privacy' in Article 42 of the Public Security Administration Punishment Law. The established principle of informed consent will be processed." Zhang Li said.

  Zhang Li believes that there are some loopholes in the legislation and practical application of relevant laws and regulations in my country.

From a legislative perspective, the latest revision of my country's Public Security Administration Punishment Law was in 2012, but with the development of the Internet and the entire information society, the definition of privacy will also undergo some changes.

In addition, the information society has also greatly accelerated the flow of information, which leads to a rapid increase in the losses suffered by those who were secretly photographed, especially the spiritual losses.

Therefore, at the legislative level, legislation on administrative penalties may need to be further updated in conjunction with the Civil Code and the Personal Information Protection Law.

From the perspective of specific practice, there is a problem that the remedies are not timely in relevant parties, and it is necessary to promote law enforcement and clarify an operating standard to protect personal privacy in a more timely and better manner.
