The National Commission for Markets and Competition (CNMC) has submitted for public consultation, until April 8, a study that analyzes waste management in Spain and, in particular, the conditions of market competition, given that " there are monopolies in collective management according to types of packaging".
The CNMC study confirms the specialization of collective management systems according to types of waste and
concludes that this leads to "de facto monopolies" for each of these types
.
In addition, it observes "certain barriers to competition" derived from the regulatory regulations, for example, in relation to the authorization process of collective waste management systems.
The CNMC justifies the need to analyze waste management both because of its economic weight and because of its "great impact" on environmental sustainability and the ecological transition, for which it
considers it "essential" that the activity be carried out in a "competitive" environment
. and favor the operation of the sector in an efficient, effective and innovative manner.
Likewise, it values that there is a margin for a greater degree of competition in waste management compared to the European Union, which could allow greater efficiency in meeting the circular economy objectives, among other benefits.
The study on waste management in Spain is part of the objective of the Action Plan and the Strategic Plan of the CNMC to promote environmental sustainability and ecological transition.
The report, which is open to public consultation for the participation of interested parties until April 8, points out that there is a "huge disparity" of the agents involved: companies, associations, public administrations, experts in the sector or individuals.
The analysis of the responses provided by the interested sectors will allow the identification of elements that can be improved, which will be reflected in the proposals to reform the current packaging waste management regulations.
