At 9:30 this morning, the case of Jiang Ge's mother v. Liu Xin was held in the second instance of the Qingdao Intermediate People's Court in Shandong Province.

Liu Xin, who had not appeared in court before the first trial and the sentencing, appeared in court today to participate in the lawsuit.

The appellant Liu Xin has now changed his name to Liu Mouxi.

The case was pronounced in the first instance of the People's Court of Chengyang District, Qingdao City, Shandong Province on January 10, and the court ordered the defendant Liu Xin to compensate 696,000 yuan.

Liu Xin later appealed.

  Today, the appellant Liu Xin and his attorney Hu Guiyun, and the appellee's attorneys Huang Leping and Li Jing appeared in court.

  In 2016, Jiang Ge, who was studying in Japan, was killed by Chen Shifeng, the ex-boyfriend of his friend Liu Xin, at the door of his residence in Tokyo. He was only 24 years old.

On December 20, 2017, the Tokyo District Court of Japan sentenced the defendant Chen Shifeng to 20 years in prison for intentional homicide and intimidation.

Jiang Ge's mother, Jiang Qiulian, has never come out of the pain of losing her daughter. She believes that Liu Xin is responsible.

In October 2019, Jiang Qiulian filed a lawsuit against Liu Xin on the grounds of infringement of the right to life, and claimed more than two million yuan.

  On January 10, 2022, the People's Court of Chengyang District, Qingdao City delivered a judgment of first instance.

The court held that Jiang Ge, as a female student studying in a foreign country, should be praised for helping her compatriots who were in trouble; she should be given legal remedies for her illegal infringement.

Liu Xin's behavior violated common sense and human feelings and should be condemned. He should bear civil compensation liability and bear all the case acceptance fees.

  In today's trial, both parties conducted evidence, cross-examination and court debate.

  The appellant, Liu Xin, stated that Jiang Ge had already taken the initiative to wait for Liu Xin without Liu Xin asking him to wait at the subway entrance.

There is no evidence to prove that Liu Xin "locked the door" after entering the room first.

It is impossible for Liu Xin to recognize and predict that Chen Shifeng will kill, let alone recognize and predict that Chen Shifeng will kill someone who has nothing to do with him.

Jiang Ge was killed entirely because of Chen Shifeng's actions.

Liu Xin believes that he is not at fault and should not be liable for civil compensation.

  The appellee, Jiang Qiulian, said that Liu Xin’s emphasis on the fact that Jiang Ge was already waiting for Liu Xin on the premise that Liu Xin did not ask her to wait at the subway entrance has no evidence to support it.

The fact that Liu Xin "locked the door" has sufficient objective evidence to prove it, and Liu Xin's denial just reproduces the situation in which Liu Xin made false statements due to shirk his responsibility.

Liu Xin has sufficient evidence to prevent Jiang Ge from calling the police.

  After nearly four hours of trial, the court announced an adjournment and sentencing at an alternative date.
