新华社广州1月27日电 题:“二手”手机号“剪不断、理还乱”,该管一管了!——新买的手机号为何“难断前缘”?

  近日,广州陈先生手机收到一条“追债”短信:“刘某某……因欠款逾期多次沟通无果,我方团队今天已开车出发前往你户籍所在地和单位分别进行核实……”陈先生很纳闷,刘某某是谁?刘某某的欠款短信怎么发到自己手机上了?打电话问营业厅后才知道刘某某是该手机号的前号主。

  因购买到“二手号码”遭遇短信电话骚扰、无法新注册App的用户不在少数,如何才能让手机号“干干净净”回归用户?对此记者展开了调查。

新买的手机号遭遇“前任”骚扰

  陈先生除了三天两头收到“追债”短信,还时常接到这个手机号的“幽灵”叫车服务。

  “你好,我的车到了,你人在哪?”2022年1月初的一天,陈先生又接到一个网约车司机的电话。“我明明没有叫车,司机为什么打给我?”陈先生告诉记者,现在这个“138”号段中国移动的手机号是2020年12月购于广州天河城某通信公司,自己从未使用该手机号注册网约车账号。

  陈先生通过网约车客服查询发现,使用该手机号的网约车用户近一年来一直在使用该号叫车,且2022年1月还有一单网约车欠款未缴。

  陈先生表示,自己已经买这个号一年多了,不明白为何前号主还能使用该手机号注册的网约车账号。“如果我自己想用这个手机号注册网约车账号,岂不是还要先帮他还钱?”

  随后陈先生打电话给移动客服,对方表示需要用户自行打电话给App平台,陈先生很不满,“前手机号主到底注册了多少个App我也不掌握,难道要我挨个打电话给平台吗?”

  不仅如此,陈先生还发现该手机号的微信账号已被注册。此前就有山东网友表示,自己的手机换号忘记解绑微信,新号主通过短信登录用户微信,向其亲友骗取了6000元。

  家在湖南的张同学去年来广州上大学后新办了一个新手机号,他就曾接到过自称是该手机号“前任”号主打来的电话,对方说自己某App的账号还绑定在这个手机号上,有个验证码发到这个手机号上了,要张同学把验证码告诉他。张同学认为无法确认对方的身份,便拒绝了。之后对方还经常打电话发短信过来骚扰张同学。

“二手号码”出现重大隐患

  用户为何会购买到二手手机号?当初购买时销售人员是否告知?陈先生找到购买手机号的广州天河城某通信公司,该公司工作人员表示,现在136、137、138这些号段放出来的手机号基本都是二手的,有的甚至是三手、四手的,要想买到全新的,基本都是187、188这些号段。“如果客户没有问,我们也不会专门说。”工作人员说。

  中国移动广东分公司有关负责人表示,由于手机号码资源的稀缺性,当客户所使用的号码销号之后,会先经过一段时间的冻结,然后重新发放给新的客户使用,根据电信服务规范相关要求,电话号码冻结时限最短为90日。

  广州天河城某通信公司工作人员说,号码注销一般分为主动注销和被动注销。对于主动销号的用户,工作人员会告知他们及时解除相关绑定;但对于欠费销号的用户,就会出现销号后手机号与第三方平台的绑定没解除的情况。

  深圳市消费纠纷评审专家、北京市东元(深圳)律师事务所律师邓永认为,放在过去,手机号注销之后“冷静”一段时间,对后续号主的使用不会有太多影响。然而随着移动互联网的兴起,各种App应用都要绑定手机号,手机号的功能不局限于通信层面。因此,过了“冷静期”之后重新投放进市场的手机号,有可能依然保持着与App应用千丝万缕的联系。

  那么手机号注销后,用户与各大App应用绑定的关系,运营商能否为之解绑?中国移动广东分公司有关负责人表示,已销户手机号码重新放号前,原有的中国移动相关业务均会彻底清理。但号码与其他第三方账号的绑定关系,运营商并不掌握。

  This means that since the operator and the third-party company have not yet established a communication mechanism on whether the user's mobile phone number has been cancelled, it not only limits the right of new users to use the app normally, but the third-party company also suffers economic losses.

Expect number "full process" cancellation

  Ms. Wang from Shenzhen thinks it's not worth spending the same money to buy a second-hand mobile phone number, "I asked specifically when I bought a mobile phone number, and the staff said that there is no difference in price and package between the new mobile phone number and the old mobile phone number. The phone number is not more favorable, but the old mobile phone number has a difference in the use rights, I can't accept it."

  Deng Yong believes that operators should protect the interests of new users when the recycled mobile phone numbers are reactivated.

When operators resell mobile phone numbers, they should inform consumers that the number is a second-hand mobile phone number, which may cause inconvenience or loss to consumers, otherwise it will violate consumers' right to know and right to choose.

  In addition, when a new user of a mobile phone number encounters situations such as the number being occupied, it means that the consumer's normal use right is restricted.

After receiving a complaint from a new user, the operator should actively contact the third-party platform to unbind the mobile phone number corresponding to the original user from the platform, so as not to infringe on the rights and interests of consumers and third-party platforms.

  Meng Bo, a lawyer from Beijing Jingshi Law Firm, believes that operators can try their best to release the business that was previously bound to the App through various methods, and can try to establish a system jointly with the Internet platform. .

It is reported that some telecommunications operators have launched Internet registration clearing services, which can clear the registration information of mobile phone numbers in some Internet companies.

"We also expect more Internet platforms to join in to jointly protect users' normal use rights." Meng Bo said.
