积极引导发展与严格依法管理并举
民政部门实现对非法社会组织“露头就打”

对于社会组织，一方面要积极引导发展，另一方面要严格依法管理，这也正是作为社会组织监管部门的民政部的工作思路。
“我们做严做实做细做好社会组织党建引领、登记管理、执法监督、培育扶持、政策激励等各项工作。”民政部社会组织管理局副局长陈小勇在近日民政部举行的新闻发布会上如是说。
在全面建成小康社会进程中，特别是在决战决胜脱贫攻坚、新冠肺炎疫情防控中，有不少社会组织作出了突出贡献，在民政部近日组织开展的第四次全国先进社会组织评选表彰工作中，这些先进社会组织受到表彰，其背后是民政部希望确保其持续发挥示范引领作用的良苦用心。同时，回顾过去一年，打击非法社会组织的风暴来袭，一大批非法社会组织被集中取缔，一大批涉嫌非法社会组织被曝光，“进一步打击整治非法社会组织专项行动”取得了突出成效。
业内专家指出，当前我们要建立健全社会组织激励机制，让能做出品牌公服产品并具备持续发展能力的社会组织及其创始人名利双收；同时要建立社会组织退出机制，把个别违法牟利，打着社会组织旗号的“公司”，或能力不强的组织逐步剥离出社会组织机体。
取缔非法组织231家
非法社会组织的辨识有时并不容易。
一家名为“全国中小学生综合素质等级测评中心”的非法社会组织，就在被取缔时给曾经趋之若鹜的家长们带来了困惑。
这是一家看起来特别厉害的“社会组织”。且不说名称中就有着“国字头”的感觉，它还制作标识、私刻印章，任命了所谓“主任”“副主任”等领导职务。在组织架构上，下设“书法专业委员会”“沙画艺术测评委员会”“街舞测评组委会”“书画测评组委会”等多个分支机构，在全国各地授牌成立“江西测评中心”“湖南测评中心”等30余家测评中心。而实际上，这只是一个“草台班子”，是一家没有在任何部门登记的非法社会组织。2021年7月，北京市民政局接到民政部转来“全国中小学生综合素质等级测评中心”涉嫌非法社会组织的线索，立即对其开展立案调查。
执法人员在调查中发现，该“中心”截取教育部2015年印发的《中小学生艺术素质测评办法》等文件中“地方教育行政部门要将学生艺术素质测评情况作为评价学校教育教学质量的重要指标”的片段，对外宣称综合素质测评结果将被纳入中小学生成长档案，作为学生中高考的参考依据，并称自己已获有关权威机构授权，其出具的“测评结果”具有权威作用。
“明明是一家‘李鬼’式的非法社会组织，竟然还准备了‘打假’的渠道。可见如今非法社会组织‘忽悠’手段之高。”执法人员说。
2021年10月，北京市民政局经过调查，认定“全国中小学生综合素质等级测评中心”未经登记，擅自以民办非企业单位名义进行活动，北京市民政局对其及下设分支机构依法作出取缔决定。2021年11月，执法人员到该“中心”办公地点进行现场取缔，并在北京市民政局官方网站进行公告。
这是各级民政部门对非法社会组织保持高压严打态势的一个例证。陈小勇介绍说，去年7月以来，各级民政部门共核查非法社会组织线索1850条，取缔231家，劝散326家，自行解散39家，引导登记104家。
坚决防止死灰复燃
在刚刚过去的2021年，对于非法社会组织的治理掀起了一个高潮。
2021年3月，民政部会同中央宣传部、中央政法委等17个部门联合召开进一步打击整治非法社会组织电视电话会议，在全国范围内部署开展了为期3个半月的“进一步打击整治非法社会组织专项行动”。
陈小勇透露，在专项行动结束后，打击整治工作转入常态化开展，各项打击整治举措力度不减、标准不降，专项行动成果得到进一步巩固深化。
此后，民政部进一步强化督促指导。先后两次召开全国社会组织登记管理系统电视电话会议，督促各地毫不松懈抓好各项打击整治举措，并结合非法社会组织呈现出的新特点，及时调整优化打击整治思路和举措，确保打击整治的针对性和有效性。
进一步抓好后续处置。印发《关于做好已处置非法社会组织相关后续工作的通知》，部署各地对近年来特别是专项行动开展以来已取缔、劝散以及自行解散的非法社会组织存续状况开展清理清查工作，发现有关非法社会组织被处置后继续活动的，及时跟进、严厉查处，坚决防止非法社会组织“死灰复燃”。其间，“中国国学院大学”众多分支机构、分布多地的“东望课堂”等被全面清理。
进一步加大查处力度。各级民政部门持续增强大数据应用能力，推进“互联网+”与打击整治非法社会组织的深度融合，实现对非法社会组织“露头就打”，始终保持对非法社会组织的高压态势。
进一步推进公开曝光。各级民政部门继续加强与新闻媒体的密切合作，保持对打击整治非法社会组织的宣传热度，全面提高社会公众的防范意识和监督意识；继续加强与各大互联网平台企业的通力协作，防范和封堵非法社会组织网上活动。部本级在专项行动期间已公布的5批被取缔非法社会组织名单基础上，又先后公布了4批名单，还首次编发了10起非法社会组织典型案例，深入揭批非法社会组织惯用伎俩和社会危害。各地民政部门持续推进公开曝光工作，在以往工作基础上，又陆续发布了30批次139个涉嫌非法社会组织名单。
进一步健全执法机制。各级民政部门结合新形势新要求，不断健全社会组织联合执法机制和资金监管机制，加强信息共享、执法联动、联合惩戒工作，强化部门联合打击整治合力，最大程度挤压非法社会组织的活动空间。
发挥作用弘扬正能量
在扎实推进打击整治非法社会组织工作，坚决防止非法社会组织反弹回潮的同时，民政部还通过表彰先进社会组织，进一步弘扬社会组织正能量。

From the perspective of industry distribution, the coverage of economic, The five major construction fields of politics, culture, society, and ecological civilization involve education, technology, culture, health, poverty alleviation, rural revitalization, public welfare, industrial promotion, international exchanges, Internet governance and many other industries and formats; The commended social organizations have played an active role in promoting economic development, prospering social undertakings, innovating social governance, expanding foreign exchanges, winning the battle against poverty, and jointly fighting the epidemic, and have achieved remarkable results.
In the future, the role of social organizations has yet to be brought into full play.
For example, in the field of rural revitalization, Professor Deng Guosheng, deputy dean of the School of Public Administration of Tsinghua University, believes that so far, the number of social organizations involved in rural revitalization in my country is not large, and there are fewer truly professional capabilities and innovative models, which requires The majority of social organizations can participate more actively in the national strategy of rural revitalization, and continuously improve their ability to participate in rural revitalization work, explore innovative models to solve the "three rural" problems, and make due contributions to the grand goal of rural revitalization in my country.
Social organizations play an irreplaceable role in social governance.
"Grassroots governance is the cornerstone of social governance and national governance, and social organizations play a role in meeting the basic needs of the public in grassroots governance. In grassroots governance, social organizations meet the needs of the public to network and make friends through the way the public spontaneously organizes various types of social groups. The basic needs of fitness reflect the social customs of harmony and friendship, and the role of social organizations in grassroots governance is indispensable." said Xu Jialiang, professor at the School of International and Public Affairs of Shanghai Jiaotong University and dean of the China Institute for Philanthropy Development.
徐家良认为，区域协同和乡村振兴是维系区域发展均衡和缩小贫富差别的重要举措，社会组织提供信息沟通、捐赠赋能、技术赋能等各方面的服务，推动信息低频道向中频道和高频道变化，形成信息同频道的交流合作，有助于保持东部地区与西部地区生活水平的同步性和整体能力的提升，进而减少矛盾与冲突，实现共同富裕，助力完成国家治理现代化的远大目标。
