This is the end of a procedure that has lasted since last year.

Spencer Elden, best known to the general public for being the baby seen on the cover of

Nevermind

, Nirvana's cult album, was dismissed in his complaint against the group by a California judge.

Now 30 years old, he said that the photo that illustrated the album could be compared to child pornography and that he had been the victim of sexual assault.

Allegations which had been considered laughable by the lawyers of the musicians: all the owners of

Nevermind

would therefore be guilty of possession of child pornography, according to this definition (and probably Spencer Elden himself…).

“He has replayed the photograph in exchange for remuneration, on numerous occasions;

he got the album title tattooed… Across his chest;

he appeared on a talk show wearing a self-parodying nude romper;

he autographed copies of the album cover to sell on eBay;

and he used the connection to try to flirt with women… ”, had argued the advice of the group, adding that the limitation period had been exceeded since 2011.

Spencer Elden's lawyers had, for their part, considered that child pornography was not prescriptible. “Any distribution or profit derived from a sexually explicit image of a child creates not only long-lasting responsibility, but also lifelong trauma. This is common to all of our clients who are victims of actively marketed child pornography, regardless of whether the image was created a long time ago, ”Marsh Law, who represents the 30-something, told

Spencer Elden's legal team had until December 30 to respond to the Nirvana camp motion, but according to the BBC, they missed that deadline.

Justice therefore decided to dismiss Spencer Elden, and his lawyers now have until January 13 to file a complaint again (probably changing the wording of their accusations).
