Regarding the system of "illegitimate estimation" that estimates the father according to the time of pregnancy and childbirth, a subcommittee of the Legitimacy Council has the right to file a "denial of legitimacy" to dissolve the relationship between the father and the child under this system. We have begun to consider expanding to children and mothers.

The "illegitimate estimation" system stipulates that a child born within 300 days of divorce is estimated to be the child of the previous husband, and the mother who wants to avoid this does not file a birth certificate and does not have a family register. In February, a subcommittee of the Legislative Council estimated that even a child born within 300 days of divorce would be the child of her current husband if she was remarried. I have summarized the interim tentative plan.

Based on this, a subcommittee of the Legitimacy Council has given the child and mother the right to file a claim that is currently granted only to the father regarding the procedure of "denial of legitimacy" to dissolve the relationship between the father and the child by "estimation of legitimacy". Has begun to be considered in the direction of expansion.

In addition, the period of the allegation, which is limited to one year from the time of birth, is extended to three years in principle from the time of birth or when the child is known, and only if certain requirements are met, the child will be able to do so. We are also considering establishing a new system that allows you to file a claim until you are 21 years old.

A subcommittee of the Legislative Council will meet about two times in the future to review the Civil Code, and will compile a draft outline by February next year.
