How to manage the hidden dangers of short videos of minors in life or privacy?

With the popularity of high-speed Internet, as long as you have a smart phone, you can become a producer of short videos.

More and more people have become accustomed to showing themselves through short videos, sharing, liking, and being on the list. A series of social networking methods have made many people addicted.

Among the huge short video producers, minors also appeared.

In order to protect the rights and interests of minors, the newly revised Law on the Protection of Minors that was implemented on June 1 this year added a special chapter on the Internet, clarifying that online platforms should protect the information security of minors and prevent their interests from being damaged.

A few days ago, some parents reported to reporters that on some short video platforms with a large number of users, there have been many short videos involving the private information of minors.

Now that the Law on the Protection of Minors has been implemented, why does such a chaos still exist?

Check the reporter's investigation.

In September of this year, when Mr. Jiang, a parent of primary school students in Chengdu, searched the parent-child paradise on the "Xiaohongshu" app, he found that this app would push himself short videos containing a large number of lives of minors. At first, Mr. Jiang thought it was the platform that recommended some teenagers. The user experience, but more and more videos that clearly reveal the privacy of minors are being pushed over, worrying Mr. Jiang.

Parents of elementary school students in Chengdu, Sichuan:

They often post short videos that are worn at home, similar to pajamas like home clothes, and post them to the App to show them. As a parent of the child, I feel very uneasy.

The reporter downloaded the "Xiaohongshu" app in September this year, and after entering the interface of this app, the reporter was prompted to register for an account.

The reporter chose an adult whose age was "20". Then, the App recommended that the reporter choose the interest section, and the reporter chose "Reading", "Stationery Handbook" and so on.

After completing the registration and entering the App’s short video page, the reporter found that the page had recommended a lot of short videos related to "Diary Handbook", and after several screen operations, some short videos with pictures of minors as the cover Recommended by App.

In several short videos, the reporter found that the video shooters were all minors themselves, and the camera was directly aimed at their private parts when taking selfies with their mobile phones.

In a short video, the location coordinates are shown as Shenzhen, and the words "Shenzhen school uniform" are added below the short video.

The reporter found that this short video, about 1 minute long, followed a female student in school uniform, walked all the way through the classroom, and finally entered the women’s toilet.

In the "barrage function" provided by the video, someone left a message asking "Which school uniform is this", and someone asked the publisher of the short video to "introduce it."

On the App page, a large number of short videos featuring minors also contain short videos introducing online games from time to time, and their names and covers have strong sexual hints.

This video account named "Game Commentary" released a short video of the game introduction, directly using the naked body of the female character as the cover, and the video also marked "Dancing without clothes" commentary subtitles.

And some videos of women with revealing clothing and a large number of short videos containing minors are also mixed together, and users cannot choose to distinguish between them.

The reporter found that in short videos containing minors, there were a large number of user messages and bullet screens, some of which contained strong sexual hints.

Below a short video of a minor filming and introducing himself to his homework, there were 29 comments. Someone left a message saying, "Sister, do you like the uncle?" Someone left a message, "Make a friend" and "Are you with someone?" Ask the minor's contact information.

Review the "carried goods" of minors with loopholes

The reporter's inquiry found that the "Xiaohongshu" App stated on its official website that the number of users exceeded 300 million.

During the journalists' browsing for more than two months, it was discovered that the platform had leaked the privacy of minors and the comments were not strictly reviewed.

How does the platform manage short videos, and how do young people release videos after entering the platform?

Some parents said that after browsing and combing about 100 accounts containing videos of minors, they found that content on content platforms that are not suitable for minor age groups such as "precocious" and "making friends" appeared in the "Xiaohongshu" App , Questioned the review of the platform.

Parents of primary school students in Chengdu, Sichuan:

I think this app should first check whether this underage video is suitable for sending. After sending it, there are many unsightly comments below. Will the child share his location and let some criminals? Have a chance?

The reporter reported some short video issues of minors that appeared on the "Xiaohongshu" platform to the "Xiaohongshu" App and learned about the relevant situation.

 Reporter:

I think the platform has pushed me a lot of minors. What is going on?

Staff: When

you register here, you will be asked to choose some categories you like. If you choose, you will be recommended according to your choice.

If you do not choose, the system will randomly recommend it.

 Reporter:

For example, there are some short videos of adults, some girls who are wearing more revealing clothes, and some showing underwear and underwear, all mixed together.

 Staff: I

'm really sorry, if there are related content, it may not be supervised here.

If you see it, I suggest you report it.

 Reporter:

You can only deal with it after I report it, right?

 Staff:

Because some of these "notes" will be published at the same time, many of our "notes" are reviewed by the system, and some may not be reviewed.

The staff of "Xiaohongshu" said that due to the large number of short videos, there were loopholes in the audit.

The reporter found that in the user agreement of the "Xiaohongshu" App, it specifically pointed out that "pay attention to the protection of the personal information of young people and children", but in its "Children and Adolescents Personal Information Protection Rules" agreement, it stated that "guardians are using the community, When posting orders and other information release functions, if you actively provide us with the personal information of children and adolescents, it means that we have agreed to our collection and use of the personal information of minors in accordance with the content of this policy."

Some legal scholars said that such a user agreement means that the platform defaults to the guardian's guardianship for the content of minors in the short video, and once it is released, it means the guardian's consent.

In a further interview with the staff of the "Xiaohongshu" platform, the reporter received a reply that "the short video platform is open to minors and does not require real-name registration."

"Xiaohongshu" App staff: Our platform registration now has no requirements for minors.

Currently, there is no requirement for real-name authentication, so basically there are mobile phone numbers, QQ, and WeChat that can be registered.

On the one hand, minors can register and use to shoot and publish short videos. On the other hand, it is stated in the user agreement that the videos are released under the guardianship of guardians by default.

Legal scholars pointed out that such an approach, the platform is suspected of shifting responsibility to the guardian of minors, and also caused the current content review problems.

Zhu Wei, deputy director of the Communication Law Research Center of China University of Political Science and Law:

Because children have no way to judge some of their private information, as a minor, the body and mind may not be fully mature, and may not understand the impact of this video. What will happen in the end.

But for the platform, it is necessary to supervise the accounts of minors additionally, and publishing any content without supervision may cause great harm to the physical and mental health of minors.

In addition to the problem of the privacy of minors being leaked, the reporter also discovered that some elementary school students have also become "cargo anchors" for merchants on the "Xiaohongshu" platform.

In a user named "Su Yiyi" on the platform, a girl wearing a certain elementary school uniform faces the camera and introduces the experience of using a piece of underwear.

The reporter found out that this short video user named "Su Yiyi" is an underwear brand.

In the App, "Su Yiyi" released 37 short videos, 6 of which contained minors, and most of the content was about the underwear wearing experience.

In a short video account, several pictures of minors wearing underwear appeared, and the names and screenshots of online shopping products were also attached.

Some netizens left a message stating that the account "is for selling clothes and should not post other people's babies online."

Short video platforms should strictly comply with legal requirements

A few days ago, the Ministry of Culture and Tourism issued an opinion on strengthening the protection of minors in the online cultural market, clearly prohibiting the use of “Internet celebrity children” for profit, strictly controlling minors’ participation in online performances, and posing indecent poses to the use of child models Accounts that attract traffic and bring goods for profit will be dealt with seriously in accordance with the law.

Data shows that as of the first half of this year, the number of short- and medium-term video users of my country’s Internet users reached 888 million. According to the “Characteristics and Protection of the Use of Short Video for Primary and Secondary School Students” released by the China Youth Research Center, nearly 70% of minors use Too short video.

Legal scholars pointed out that in the context of the ever-increasing audience of short videos, online platforms should strictly implement laws and regulations to effectively protect the rights and interests of minors.

The newly revised Law on the Protection of Minors, which was implemented on June 1 this year, clearly requires network service providers to strengthen management of users and information, and promptly take corresponding measures when discovering illegal information or infringing criminal acts against minors.

Regarding the short video platform that provides channels for minors to register, legal scholars said that the platform should strictly implement the provisions of the Law on the Protection of Minors, and carry out special classification management of short videos involving minors, and their accounts and adults should not be left alone. The accounts are mixed together, and should not be actively recommended to unfamiliar users.

Wang Sixin, Professor of Communication University of China, Vice President of Beijing Cyber Law Research Association:

We have a principled requirement, that is, the information security of minors must be ensured, as well as the security of his (her) offline behaviors due to online behavior. As long as there are security loopholes, no matter what kind of misleading information, or induce young people to take improper behavior, these platforms have the responsibility to avoid it, and also have the responsibility to take active preventive measures.

If the platform fails to take precautionary measures, or is unable to do well, our punishment must be promptly followed.

Regarding the issue of real-name registration, since the implementation of the Cyber Security Law on June 1, 2017, management regulations involving Internet communities have been promulgated one after another, clarifying community services in Internet forums, post comment services, group information services, and public account information The principle of "real-name back-end and voluntary front-end" is implemented in the service.

Legal scholars pointed out that the online platform ignores relevant laws and regulations, causing damage to the rights and interests of minors, and will also be held accountable by law.
