For Emmanuel Macron, this is "not the time to annoy the French" with a provision that was to be applied everywhere in the European Union on January 1, 2022: the biennial technical inspection of motorized two-wheelers.
France will therefore not be seen as a model in this area, while the decree published on August 11, 2021 and suspended the next day by the Head of State provided for a gradual entry into force from 2023.
It is therefore not surprising to see the Council of State rejecting a request from local residents' and environmental defense associations, which demanded compulsory technical inspections from 2022. The EU has nevertheless left time for the States to put it into effect. place, requiring technical inspections of two-wheelers since 2014 to improve road safety, protect the environment and limit noise pollution.
Most European countries have implemented it, but not Finland, Ireland and the Netherlands, which have implemented alternative measures.

The association "Respire" for the fight against atmospheric pollution as well as Ras le Scoot and Paris Sans Car had filed a request for excess of power and a summary suspension before the Council of State, requesting the application of this technical control as soon as possible. January 1, 2022 to comply with European law. They had stressed the urgency to fight against air pollution and noise pollution, and to reduce the mortality of motorcycle drivers through technical control.
But on Tuesday, the summary judge of the Council of State considered that this request did not represent "an emergency justifying that a suspension measure be pronounced", but it could be examined on the merits in the first half of 2022. A "device alternative ”is, however, already in preparation at the Ministry of Transport.
It must then be presented to the biker federations, then to Brussels, in order to enact a new text which will replace the decree of August 2021.
