  The matter also started in 2005. Xiaoxiao was fraudulently used by her younger sister who had not reached the legal marriage age to apply for a marriage certificate with Yu. Due to the negligence of verification by the Civil Affairs Bureau, a marriage certificate was issued for the two.

In March 2013, when Xiaoxiao and Li went to the Civil Affairs Bureau to apply for marriage registration, they were told that they had already registered with a certain marriage, and they were married.

Subsequently, the Civil Affairs Bureau applied for a marriage certificate for Xiaoxiao and Li by re-applying.

  Due to many inconveniences to life, between 2013 and 2019, my sister began to apply for correction of marriage registration information.

After several applications to the Civil Affairs Bureau to cancel the wrong marriage registration with her husband in the name of her sister, she was rejected on the grounds that there was no coercion in the marriage registration.

In September 2019, Xiaoxiao filed a lawsuit in the court again, requesting to revoke her marriage registration with Yu. She was also ruled to dismiss the lawsuit on the grounds of exceeding the five-year lawsuit period and without justifiable reasons.

In May 2020, Xiaoxiao applied to the Longchuan County Procuratorate for supervision.

  In order to further understand the situation and resolve the conflict, the Dehong Prefecture Procuratorate and the Longchuan County Procuratorate formed an integrated case-handling model to carry out investigations. After investigation, the Civil Affairs Bureau failed to perform the verification obligation, causing the sister to defraud the marriage registration with a false identity and violated the marriage registration management. system.

At the same time, the Civil Affairs Bureau failed to inform Xiaoxiao of the legal remedies for revoking the original marriage registration when his identity information had been fraudulently used and there was a marriage registration, and instead issued a marriage certificate to the parties in the form of reissuance.

The procuratorate believes that the administrative actions above the Civil Affairs Bureau are improper.

  As this case has exceeded the time limit for prosecution, in June 2020, the procuratorial agency decided to adopt a public hearing to facilitate the administrative agency to reach a settlement with Xiaoxiao and resolve the dispute in a timely manner.

Subsequently, the procuratorial agency issued procuratorial recommendations to the Civil Affairs Bureau, suggesting to improve the regulatory mechanism for marriage registration, and do a good job in the notification of rights and obligations.

  After receiving the procuratorial advice, the Civil Affairs Bureau improved the work system and cancelled the wrong marriage registration for the two sisters.

So far, the registration of this fake marriage has been corrected.
