Six years ago, in a trial in which the bereaved family of a woman who died in a small aircraft crashed in a residential area near an airfield in Chofu City, Tokyo, was seeking compensation, the Tokyo High Court of the second instance admitted the captain's negligence. He sentenced the company that managed the small aircraft to not accept responsibility.

In 2015, a small propeller plane that took off from Chofu Airport crashed into a nearby residential area, killing the captain, passengers, and three 34-year-old women in the house at the crash site.

Tokyo, which manages the airfield, asked for compensation, and the first trial was in Tokyo. The district court admitted the negligence of the two companies and ordered a total of more than 75 million yen in compensation.

The small aircraft management company appealed the decision, and in the judgment of the second trial on the 13th, Judge Kazuhiro Yagi of the Tokyo High Court said, "It can be said that the captain had negligence in maneuvering, but with the small aircraft management company. There remains doubt that there was a substantial command and supervision relationship with the captain, "he said, not acknowledging the responsibility of the management company.



Since the amount of compensation for the bereaved family is fixed in the first trial, only the captain's company will be liable for compensation if the judgment of the second trial is finalized.



In addition, the bereaved family has withdrawn the appeal to Tokyo.



Saeichi Nakatani, a lawyer on the bereaved family side, said, "I would like to consider an appeal in a judgment that I cannot accept."
