A man in Xunyang, Shaanxi Province was sentenced to eight months in prison for making malicious calls to the police more than two hundred times

  On September 17, the Criminal Tribunal of the Xunyang City People’s Court in Ankang, Shaanxi opened a public hearing on the case of Chen Mouliang’s crime of provoking quarrels filed by the Xunyang City People’s Procuratorate. The defendant Chen Mouliang maliciously dialed more than two hundred calls to the police. In the first instance, he was sentenced to eight months’ imprisonment in accordance with the law.

  After the trial, it was found that the defendant Chen Mouliang was dissatisfied with the results of the investigation and handling of the clues reported by the public security organs, coupled with heavy work and life pressure, so he called the Ankang City Public Security Bureau and Xunyang County Public Security Bureau many times to receive police officers. From September 2020 to March 2021, the defendant Chen Mouliang used multiple phone numbers to make 77 calls to the police and public alarm numbers of the command center of the Ankang Public Security Bureau, and to the public alarm calls of the Xunyang Public Security Bureau. There were 92 calls and 169 insults to the police officers.

After being warned by the police from the Xunyang City Public Security Bureau, the defendant Chen Mouliang refused to follow the advice of the police and continued to commit abusive behaviors a total of 48 times.

  During the trial, the defendant Chen Mouliang stated in court that he had no objection to the facts and charges charged by the public prosecutor, sincerely repented, and voluntarily pleaded guilty and pleaded guilty.

The collegiate panel found that the defendant Chen Mouliang, in order to vent his emotions and excuse himself, made several calls to the police number 110, insulted police officers at will, occupied the alarm line, abused police resources, and seriously disrupted the normal work order of the public security organs, and the circumstances were bad. His behavior violated the provisions of Article 293, Paragraph 1, Paragraph 2, of the Criminal Law of the People’s Republic of China, and constituted the crime of creating disturbances and provoking trouble. He was sentenced in court: the defendant Chen Mouliang was sentenced to eight months’ imprisonment in accordance with the law.
