Eighteen years ago, a woman who was acquitted in a retrial = redo trial over the death of a patient at a hospital in Higashiomi City, Shiga Prefecture, was asked by the prefecture for damages. Governor Crescent apologized to the woman, saying, "It was an extremely inappropriate expression," for alleging that she denied the acquittal in the retrial, saying, "I made the patient cardiopulmonary arrest."

Mika Nishiyama (41), a nursing assistant at the Koto Memorial Hospital in Higashiomi City, was sentenced to 12 years in prison for murder over the death of an inpatient in 2003, and then started over last year. The trial confirmed his innocence.



Mr. Nishiyama has filed a civil trial seeking damages against Shiga Prefecture, alleging that he was detained for a long time due to an unjust investigation by the Shiga Prefectural Police.



On the 16th, Shiga Prefecture insisted that it was Mr. Nishiyama who put the patient in a state of cardiopulmonary arrest at a private proceedings meeting held at the Otsu District Court, denying the content of the acquittal of the retrial.



Regarding this, Governor Crescent held a press conference at the prefectural office on the 17th, saying that he did not understand the content of the allegation, and said, "While the acquittal has been confirmed, will Mr. Nishiyama conclude that he has caused cardiopulmonary arrest? Such an expression is an extremely inappropriate expression that deeply hurt Mr. Nishiyama's feelings, and I would like to sincerely apologize. "



On that basis, Governor Crescent wants to coordinate with the court to revise the content of the allegation and, based on the fact that the acquittal has been confirmed in future trials, will dispute whether or not he is liable for damages.
