The battle between long-established rivals over Kyoto's famous confectionery "Yatsuhashi" is settled.

In a trial in which a company that indicated on its products that it was founded more than 300 years ago was asked to suspend the labeling by claiming that another company had no basis, it was decided that it was not necessary to stop the labeling. Did.

The complaint was made by the long-established manufacturing company "Izutsu Yatsuhashi Honpo", which has its head office in Ukyo-ku, Kyoto.

"Rationale" for the fact that the rival company "Seigoin Yatsuhashi Sohonten" indicates that the store's goodwill and product packaging indicate that it was founded in the Edo period "Genroku 2 years" more than 300 years ago. It misleads consumers that it is a product that they have been making since the Edo period, even though there is no such product, "and asked the company to suspend the labeling and compensate for 6 million yen.

The Kyoto District Court of the first instance pointed out last year that "it only brings consumers the perception that it was founded in the Edo period, and it is not a misleading indication." He also dismissed the complaint, saying, "There is no definite proof that it is wrong."

And the second trial also decided that it was not necessary to stop the display, so the company that filed the complaint appealed, but Katsuya Uga, the judge of the third small court of the Supreme Court, decided to dismiss by the 16th. The plaintiff's defeat has been confirmed in the dispute between rivals over Yatsuhashi.
