China News Service, Changsha, September 10 (Reporter Tang Xiaoqing and Yang Huafeng) On September 10, the Yuelu District People’s Court of Changsha City conducted a public trial and went to court on the case of the Yuelu District People’s Procuratorate accusing the defendant Zhou Yangchun of negligence causing death. The sentence was pronounced, and the defendant Zhou Yangchun was found guilty of the crime of negligence causing death and sentenced to one year’s imprisonment and one year’s suspended sentence.

  The court found out after trial that the defendant Zhou Yangchun was a signed driver of Shenzhen Yishihuo Lala Technology Co., Ltd.

On the afternoon of February 6, 2021, after Zhou Yangchun received the order of the victim's car to move through the platform, he drove to the agreed place at 20:38 that day.

Zhou Yangchun was dissatisfied because the car refused his suggestion of paying for transportation, and because the waiting time was long for loading and the order was not profitable.

At 21:14, Zhou Yangchun set off with the car, but did not remind the car sitting in the passenger seat to fasten the seat belt.

On the way, Zhou Yangchun asked Che to provide unloading and handling services for a fee, but was refused again, and became more dissatisfied.

  In order to save time, Zhou Yangchun did not follow the recommended route of the platform, but chose a relatively time-saving but relatively remote route by himself.

Che found that Zhou Yangchun had deviated from the navigation route and drove into a remote section. He repeatedly prompted a yaw, Zhou Yangchun either ignored it or had a bad attitude.

Che Moumou was frightened, and he stuck his head out the window and asked to stop. Zhou Yangchun still ignored him.

Later, Zhou Yangchun found that Che was holding the lower edge of the right side window of the truck with both hands, and his upper body protruded out of the vehicle. Zhou Yangchun had realized the real danger that Che might crash, but did not stop or take braking measures.

Subsequently, the car fell from the car window.

Zhou Yangchun stopped and dialed the emergency number 120 and the police number 110.

On February 10, Che died after being rescued.

It was identified that the head of the Che XX Department collided with the ground and caused severe head injury and died.

  After the incident, Huolala paid medical expenses and funeral expenses to Che's parents.

  The court found that the defendant Zhou Yangchun, as the contracted driver of the Huolala platform, was dissatisfied because of the long waiting time for loading and the refusal of two proposed toll removal services.

It violated the platform safety rules, neither reminding the car to fasten the seat belt, nor ignoring the car's opinion against yaw, driving to a relatively remote section, causing the car to leave the seat and lean out of the car window in fear.

Zhou Yangchun had foreseen the possible crash of the car after discovering the dangerous behavior of the car, but believed that it could be avoided, and failed to take effective measures in time to cause the dangerous result of the crash of the car.

There is a causal relationship between Zhou Yangchun's negligent behavior and Che's death in the criminal law. His behavior has constituted the crime of negligence causing death, and the crime charged by the public prosecutor is convicted.

Zhou Yangchun had surrendered, confessed guilt and punished voluntarily, and actively rescued the victim. The court adopted the sentencing recommendation of the public prosecutor and made the above-mentioned judgment in accordance with the law.

  The People's Court of Yuelu District formed a collegiate panel to hear the case in accordance with the law, and held a pretrial meeting on September 6.

During the trial of the case, the court fully protected the defendant Zhou Yangchun's various litigation rights, and the defender defended according to law.

Some deputies to the National People's Congress, the victim and the defendant's relatives and friends attended the court hearing.
