Xavier, taxi-ambulance driver in Moselle, was fired on June 29.

The company that employed him criticized him for being absent when he was injected with his second dose of the Covid-19 vaccine.

The driver told Lorraine Actu that he had informed his employer the day before and the same day of the vaccination.

He had previously tried to use a vacation day for the occasion.

“My second dose of vaccine was scheduled for June 29, so I took paid leave on June 21, which was refused,” Xavier testified.

On his return, the employee learned that he was going to receive "a registered letter for a disciplinary sanction".

His company eventually fired him for serious misconduct.

Abandonment of the boss

The driver announced that he wanted to sue his employer at the Prud'hommes.

"I am criticized for having been vaccinated," he denounced.

It is an unfair dismissal.

[…] People who are not vaccinated are fired and I am fired because I am getting vaccinated ”.

The Mosellan is suffering from a pathology forcing him to be vaccinated, which his boss knows.

The latter, for his part, indicated that he had dismissed his driver for "abandoning his post".

The manager explained that after the refusal of paid vacation due to numerous absences, "several alternative solutions were offered to the employee and he refused them".
