The defendant withdrew his appeal after the first trial decision, and the Osaka High Court also admitted this.

Koji Mizuumi, a former surname, Koji Yamada (51), who was sentenced to death in the first instance for murdering a man and a woman in the first grade of junior high school in Neyagawa City, Osaka in 2015, is in trouble over lending and borrowing a ballpoint pen with a prison officer in a detention center. Immediately after becoming, I withdrew my appeal.

On the other hand, the lawyer petitioned to continue the hearing, and the Osaka High Court made an unusual decision invalidating the withdrawal of the appeal, saying, "I feel a strong sense of discomfort and deep hesitation in finalizing the death penalty as it is."



However, the defendant filed a motion to withdraw the appeal again, and the Osaka High Court approved the withdrawal this time in November last year, and another judge of the Osaka High Court also approved the withdrawal of the objection from the lawyer.



The lawyer had made a special appeal against this, but Katsuya Uga, the judge of the Supreme Court's Third Small Court, decided to dismiss it by the 27th.



As a result, the death penalty of the defendant was confirmed without the hearing being held in the second trial.
