On-demand driving on the "streaking" road

11 kilometers actually received 159 yuan, the barbaric growth of the driving market urgently needs to be regulated

In recent years, as citizens’ awareness of “drinking and not driving” has increased, more and more car owners have become accustomed to looking for driving services after drinking.

However, with the rapid development of the agent driving industry, chaos has also followed: low entry barriers, frequent "black generation driving", random asking prices, and insecurity of driver rights and other issues have become more and more prominent.

What is the root cause of "black driving"?

According to industry insiders, the root cause is that the agent driving industry is still "streaking"-lack of industry standards and institutions to regulate, and it is in a state of "three noes" with no supervisory unit, no industry standard, and no barriers to entry.

Qilu Evening News, Qilu One Point Reporter Ji Mingzhi

With a distance of 11 kilometers, the driver’s fee is as high as 159 yuan. Users want to go back to contact rights protection and find that the phone can’t get through... With the rapid development of the driver’s behalf, many "black drivers" do not have charging standards and ask for excessive prices, triggering a lot of consumption Those criticized.

  Customer complains:

11 kilometers spent 159 yuan to complain about nowhere

Zhang Jie (pseudonym), a citizen who lives in Lixia District, Jinan City, had the experience of calling Heidaijia: for a distance of 11 kilometers, the driver actually charged her 159 yuan.

According to the driving mileage provided by Zhang Jie, the reporter saw on a certain driving platform that the estimated price was around 55 yuan.

Zhang Jie said that she had just come out of a hotel in the Olympic Sports Center, and saw a driver wearing a vest and helmet at the door. She thought it was a regular driver, so she called him.

After arriving at the destination, the driver asked her to show the payment code and swept away 159 yuan. There was neither a itinerary nor a fee.

Zhang Jie felt wrong after waking up, and she couldn't get through when she called the driver.

"Forget it, I don't know who to complain to, it's not enough trouble." Zhang Jie said helplessly.

Judging from Zhang Jie's payment records, the payee is a certain driving service company in Jinan City.

The Qilu Evening News Qilu Yidian reporter then inquired about the industrial and commercial registration, but did not find the company's registration information.

The reporter also followed Zhang Jie's driving route and searched on a certain driving platform. According to the price displayed on the platform, the estimated price of the road Zhang Jie took was around 55 yuan.

For this kind of "black driving", Master Lu, who has been a driver for many years, said, "It's normal. You haven't seen rainy days, and they will ask for more severe prices in bad weather. This transaction is a one-off deal. Count one, because the possibility that the two sides will meet again next time is almost zero."

  The threshold is very low:

Buy a vest for more than ten yuan to get on the road

A reporter from Qilu Evening News and Qilu One Point recently visited the provincial capital and found that when night fell, there would usually be a group of driver drivers waiting to take orders, or three, five, or a dozen people gathered at the entrance of major hotels.

They were uniformly wearing vests with the words "Driving Driving", wearing safety helmets, and riding small or unlicensed electric vehicles.

At the gate of Jingshilu Shunhe International Hotel, Mr. Liu, who was waiting for an order, told reporters that he can receive 2-3 orders in one night, and he can get about 200 yuan, and the orders on weekends can almost double.

While talking, he saw a guest coming out of the hotel, he hurried forward and asked, "Do I need to drive?" But the guest ignored him.

"This is the case when working in the service industry. Just be diligent." Master Liu told reporters. "I used to be a full-time driver on the platform for seven or eight years. Later, I felt that I was too old and couldn't afford to stay up all night. It's done, it's the so-called "black driving". "Without an online order, Master Liu can only stop by the door of the hotel, and when he sees the guests, he asks.

"Playing and doing it, one month's money for tobacco and alcohol will be earned." As for how to set a price for the guests, he said with a smile: "It's not that I haven't done it before, just make an appointment."

For "black driving", it is not difficult to get into the industry.

Master Liu told reporters that now, the equipment for driving on behalf of you can be bought anywhere, you can buy it online, or you can find a driver who will do on behalf of driving and buy it from the platform.

However, he particularly emphasized: "If you do not have insurance, it is equivalent to walking a tightrope. You must be steady, and don't make any accidents, otherwise the money you earn is not enough to fill the hole."

The reporter searched for the word "Driving" on an e-commerce platform, and the related supplies about "Driving" are all available.

The reporter immediately opened a shop that sells driving vests. The customer service said that the vests can be customized with logos at will, and a single piece is 15.5 yuan.

Looking at the sales of this store, the monthly sales have reached more than 200 pieces, and the most store sales have reached more than 3,000 pieces.

Precisely because it is easy to purchase driving equipment, it provides convenient conditions for drivers to be "black driving".

Zhang Jie said: "They are all wearing vests and helmets. How can people who drink alcohol think too much? Getting scammed often starts from here."

Through interviews, the reporter found that even for a formal agency driving company, many of the audits of drivers are mere formalities.

Hou Kun (a pseudonym), a driver master of a certain driving platform, told reporters that they are very easy to get a job, as long as they have been driving for 3 years.

The platform does not have a labor contract, so just fill in a form. Although you will also ask if you have a criminal record, as long as you say no, the platform will not conduct a special investigation. After a brief training, it will be over.

  On behalf of the driver:

  Own rights cannot be protected

This year is the 10th year that drunk driving has been imprisoned. Statistics show that in the past 10 years, the cumulative demand for driving on behalf of the country has exceeded 1.6 billion person-times.

According to the company's data, as of now, there are more than 24,000 registered companies involved in the driving business in Shandong alone, and more than 7,000 in Jinan.

With the proliferation of agent driving platforms, there are many online agent software development advertisements.

The reporter contacted a driver software development company called Kylin Technology. The staff said that the initial investment of the company is not large, and a complete set of driver driving systems can be developed for 50,000 yuan. There are nearly 100 companies."

The chaos in the driving industry has not only prevented consumers' rights and interests, but also the labor rights of the drivers themselves.

Hou Kun is a middle-aged newcomer to driving on behalf of others. In April of this year, he had just been working on behalf of driving for a month, and he broke his femoral neck on the way to take orders.

From the fall to the present, Hou Kun spent more than 30,000 yuan before and after, until now he is still bedridden, but the driving platform he is on has never reimbursed him for any medical expenses.

Recalling the day of the fall, Hou Kun said that there was nothing to think about at the time, and it would be fine to take a day off, and then he contacted the platform to replace the driver to complete the order.

But one day later, he went to the hospital for an examination and found that it was a femoral neck fracture.

After the operation was completed, Hou Kun contacted the platform. The platform said that it could not find the order at the time and did not give a certificate of dispatch. It has been delayed until now, and the insurance company has not been able to intervene.

"They even said that I was a liar." At this point, Hou Kun choked.

The reporter contacted the platform, and the customer service said that the accident needs to be reported in time for insurance. He did not understand the matter and needed to report to the leader before replying, but the reporter did not receive a relevant reply as of press time.

"It is true that there will be a few colleagues who earn 16,000 yuan a month, but that is to exchange life for money and work all night long. Several people around me have fallen ill. A colleague has a brain hemorrhage. It's still in the hospital now." Hou Kun said.

Except for Hou Kun's injury when taking orders, it is more common that passengers do not pay for driving.

"Some passengers may use this time on behalf of the driver, and will not use it in the future. It is difficult for us to get the money back. I still have five or six such bad orders in my hand." The driver Cui said, currently Customer complaints also give them a headache.

"In many cases, as long as there is a complaint, no matter whether it is right or wrong, even if the complaint is established on the platform, it will be blacked out for a day when it encounters a complaint, and it will not be able to receive the order."

Regarding the driver’s rights and interests, Wang Xuantong, the person in charge of e-drive Jinan, told reporters that the agent-drive company and the agent-drive master are not actually an employment relationship, but a cooperation model.

Because of the particularity of the industry and the large turnover of personnel, it is not easy to pay five social insurances and one housing fund.

Regarding the "bad orders" complained by drivers, Wang Xuantong said that this is actually two aspects, one is communication skills and the other is civilized collection.

Some passengers say that they will pay the next time they use it, which is not wrong.

However, the frequent calls of the driver's behalf may cause harassment to the passengers, and the platform will also make judgments according to the specific circumstances.

  Industry supervision:

Still in a state of "three no matter"

The reporter's investigation found that, like the previous Huolala incident in Changsha, the agency driving industry is currently outside of supervision.

Since 2003, when the country's first agency driving company was registered and established in Beijing, there is still no regulatory authority specifically for agency driving.

The reporter contacted the Jinan City Transportation Bureau. The person in charge stated that the agent driving industry is not within the scope of its supervision. From a national perspective, there is no clear supervision department.

According to the actual situation, the problems involved in driving on behalf of others are mainly concentrated in the departments of transportation, price and market supervision.

According to industry insiders, the current agent driving industry is a typical “three nos” industry with no supervisory unit, no barriers to entry, and no unified standards. In the face of the development of emerging industries, supervision often lags behind.

Regarding the problems existing in the current agency driving, Zhang Fashui, a national first-level lawyer and director of Shandong Lawce Law Firm, said that the agency driving industry should be more stringent than taxi drivers because of its special user groups.

From a realistic point of view, because of the low barriers to employment, drivers have a mixed business level, and many personal injury accidents have occurred.

After these things appear, how to divide the responsibilities, there are many points worthy of discussion.

Zhang Fashui said that because the driver of the driver is usually drunk passengers, while the driving skills are excellent, they must also have strict requirements on moral quality. They must strictly check whether they have criminal records in the past, such as whether they have infringed upon them. Women, illegal acts of theft.

Looking at it now, there is no legal requirement for this type of industry qualification.

Zhang Fashui suggested that with the development of the industry, people's demand for substitute driving has increased. This requires timely legal regulations to clarify their qualification requirements and rights and obligations.

With the constraints of the legal system, it will help the driving industry to develop more benign and healthy.
