Harvey Weinstein has convinced a Los Angeles judge to drop one of a total of 11 sexual abuse charges against him,

The charge in question has been dropped due to statute of limitations.

Prosecutors do, however, have the option to reformulate and file the charges.

The lawyers for Weinstein, who was previously sentenced to 23 years in prison in New York, see the dropped charges as a victory.

"This is a good start."

The 69-year-old Weinstein wore a face mask and a brown prison suit during the session on Thursday.

He was wheeled in in a wheelchair.

Weinstein was extradited to California earlier this month for a new trial.

He is suspected of raping and recommending five women.

That would have happened between 2004 and 2013.

If he is convicted again, he will spend the rest of his life behind bars.

A new hearing in the case will take place on September 13.
