After several days of negotiations between parliamentarians, the National Assembly finally adopted by majority the text of the health law on the night of Sunday to Monday.

If Emmanuel Macron had announced the main points during his speech to the French, amendments had been tabled during the debates in the Senate and in the Assembly in order to rethink certain measures.

Several modifications to the initial text were finally retained.

No compulsory health pass for large shopping centers

Contrary to what had been announced, the health pass will not be compulsory in shopping centers and will not be systematically required in large shopping centers.

The decision to impose it could simply be decided locally by the prefects "if the conditions so require, while guaranteeing access to essential services".

The terraces concerned

For bars, restaurants and cafes, the sanitary pass will be required from customers whether they are seated inside or outside.

The terraces are therefore affected by the new law, despite the Senate's request to remove this obligation.

Reduced penalties

Establishments that do not control the health passes of their customers escape the fine of 45,000 euros and the suspended prison sentence initially provided for by the text.

Cafes, bars, cinemas, museums or even restaurants risk instead a formal notice by the administrative authority.

It may lead to an administrative closure of the premises for up to seven days.

It is only if the establishment is caught three times in 45 days that the manager will risk a fine of 9,000 euros and one year in prison.

The absence of controls for long-distance TGV, intercity, coach and plane journeys will be directly sanctioned with a fine of 1,500 euros to transport companies.

No layoffs

As planned, the health pass will be compulsory for employees of establishments open to the public such as cafes, bars, restaurants, museums, cinemas, zoo, as well as for nursing and non-nursing staff in hospitals and nursing homes.

The deadlines do not change either: the first have until August 30 and the second until September 15 to have a valid health pass.

However, if they do not present a pass from these dates, they cannot be dismissed after two months as provided for in the original text.

However, their contract will be well suspended, as well as their pay.

Mandatory isolation

People who test positive for Covid-19 must remain isolated in a chosen place for a period of 10 days.

Leave will be granted between 10 a.m. and noon.

In case of non-compliance with this quarantine, they risk a fine of 1,500 euros.

The checks will be carried out by Health Insurance.

What about minors?

The text provides that adolescents from 12 to 17 years old must, like adults, present a health pass to go to certain places.

However, they benefit from an additional period of time compared to their elders since they have until September 30 to comply.
