The Council of State examined Monday the government's bill concerning the extension of the health pass.

The magistrates validated it as well as the establishment of a compulsory isolation period for people tested positive for the coronavirus. 

The Council of State validated Friday the government bill which provides for the extension of the health pass and the vaccination obligation of caregivers. He also gave a favorable opinion on the establishment of a mandatory ten-day isolation period for people who test positive for the coronavirus. The magistrates, however, retested the obligation to show a health pass to enter large shopping centers. 

The compulsory isolation period for people who test positive for the coronavirus, provided for by the government, has been validated by the Council of State, which still recommends not to carry out a police check at home after 9 p.m.

In its opinion delivered Monday on the bill examined the same day in the Council of Ministers, the Council of State "recommends to specify expressly (...) that the controls cannot take place at night time", the government thus retaining 9 pm "time terminal".

A fine of 1,000 euros will be sent in the event of the first failure to check.

For its part, the National Academy of Medicine warns against this measure.

She believes that this could encourage "bypassing the screening procedures".

The obligation to control the health pass in large shopping centers has, on the other hand, been challenged by the magistrates.

the Council of State underlines in particular that this provision is "likely to relate in particular to the acquisition of essential goods, in particular food", seeing in it "a disproportionate interference with freedoms"
