  In the eyes of some netizens, the biggest reason why some people dare to harm the animals in the scenic spot so unscrupulously is that this kind of behavior is difficult to be punished. Just like this incident, the woman was not punished in the end.

  "This kind of behavior really cannot rely solely on appeals and self-moral restraint, but must wear the "golden hoop" of the law." Zhu Wei, deputy director of the Communication Law Research Center of China University of Political Science and Law, pointed out in an interview with a reporter from the "Rules of Law Daily" that the scenic spots hurt Animal incidents occur frequently. In order to protect animal safety and reduce uncivilized behaviors in scenic spots, legislation should be considered to regulate such behaviors.

Repeatedly banned feeding

In the case of the woman dragging the peacock feathers, the response from the scenic area involved "if it is found on the spot, it can only be stopped and cannot be punished" seemed rather helpless.

  Wang Tianxing, deputy director of the Cultural Tourism Policy and Regulation Center of Beijing International Studies University, said that according to current regulations, scenic spots do not have the right to penalize. Once problems are discovered, staff should stop them in time and report to the police to solve them. For example, there is a police station in the Beijing Zoo. It is convenient to deal with disputes in time.

  In fact, in the park regulations currently promulgated in some places, regulations have been made against tourists injuring and feeding animals in scenic spots.

  For example, the "Beijing Park Regulations" stipulates that tourists visiting parks are prohibited from intimidating, throwing, hurting animals or feeding animals in non-feeding areas. For violations of the regulations, corrections are ordered and a fine of 50 yuan up to 100 yuan can be imposed.

  "Such punishments are administrative punishments and are assigned to the Urban Management Bureau. Scenic spots have no right of punishment."   In Zhu Wei's view, making good use of the tourist blacklist system is also the key to punishing such behaviors that harm animals.

  The “Interim Measures for the Management of Records of Uncivilized Tourist Behaviors” implemented in 2015 stipulate that the national and provincial tourism administrative departments can set up “Records of Uncivilized Traveling Behaviors” within their administrative areas to link uncivilized behaviors with citizens’ personal credit or integrity , Create a dishonest file.

This system is also known as the tourist blacklist system.

  But judging from the actual implementation, at least in terms of behaviors aimed at harming animals, the effect of the tourist blacklist system is very limited.

Zhu Wei pointed out that, on the one hand, the several items listed in the Measures should be included in the “records of uncivilized behaviors of tourists”. Most of them are damage to public facilities and cultural relics, excluding behaviors such as harming or feeding animals; on the other hand, , There is no clear stipulation in the method as to the impact of being included in the "Record of Uncivilized Traveling Behaviors" on tourists.

  In this regard, Zhu Wei suggested to further improve the tourist blacklist system, increase regulations on behaviors such as unreasonable feeding, malicious harm to animals, etc., especially to formulate severe punishment measures to strengthen the binding force.

Missing a special law

  "For malicious acts of harming animals, it is useless to rely solely on moral restraint and must be severely punished by the law." Some netizens attribute the unscrupulous behavior of some tourists to the lack of my country's animal protection laws.

Although my country has a wildlife protection law, it is mainly aimed at wild animals. It is difficult to protect animals raised in scenic spots, domestic pets, etc., and there is no comprehensive animal protection legislation.

  Zhao Wanping and Zhu Lieyu both suggested that before the law is enacted, consideration may be given to adding animal cruelty penalties to the Law on Public Security Management Punishments, including animal cruelty and malicious harm to animals into the scope of public security management penalties to increase the cost of violations.
