Died in 2009 after unloading green algae on a beach in Binic (Côtes d'Armor), the driver worked for the company Nicol Environnement. Thursday, the lawyer for his family asked for the recognition of the "inexcusable fault of the employer" before the court of social security affairs (Tass) of Saint-Brieuc.

Thierry Morfoisse died on July 22, 2009 at the age of 48 after being poisoned by hydrogen sulfide (H2S) released by rotting algae.

His defense considers that his employer "has not implemented the necessary means of protection to remove his employee from the risk of being poisoned by deadly gas," pleaded François Lafforgue.

At the hearing, he demonstrated “the absence of the provision of masks, gas detectors, the absence of information from employees and of awareness, on the part of the employer, of the risk to which he was exposing his employees. employees ".

The recognized work accident but ...

In June 2018, the Tass de Saint-Brieuc had already recognized the death of Thierry Morfoisse as an occupational accident. The company's lawyer, Me Thomas Humbert, for his part pleaded the absence of a clearly established link between the death of the driver and the presence of green algae. "The court issued an order dismissing the criminal proceedings in 2016. The industrial accident was recognized after four refusal decisions by Social Security bodies," said Me Humbert, referring to "the lack of certainty ". "There are medical elements which, in this file, show that the origin of the death is absolutely not related to green algae", he added.

This is not the opinion of Me Lafforgue, for whom, "even if Thierry Morfoisse would have had a medical predisposition, in particular cardiac, the exposure to hydrogen sulphide, against which he was not protected, contributed upon his death ”.

The judgment was reserved for October 14, 2021.

The hearing took place on the eve of the delivery of the report of the Court of Auditors, which must be made public this Friday.
