Chinanews.com, Nanjing, April 29 (Lu Zhijian, Chen Ying, Tang Jian) A 9-year-old girl pretended to be a 16-year-old to log on to the online game platform, not only indulging in the game, but even being molested in the game.

How to protect young children from online games and Internet infringement?

Recently, Jiangsu prosecutors issued successive procuratorial recommendations to online game companies, requesting time-limited rectification and urging to ensure that the rectification of the game platform is in place.

In 2020, the police in Wuxi, Jiangsu opened a case to investigate a child molestation case on the Internet.

Elementary school student Li Yi (pseudonym) has been exposed to mobile phones for a long time due to online lessons.

When playing a game on an online game App, Li Yi received an application for adding a friend from a stranger. After adding a friend, the other party claimed to be Wang Qiang (a pseudonym) and asked Li Yi's age.

Li Yi lied that she was 16 years old, which is the fake age she used to log on to the game platform.

After that, the two played games together until the dead of night.

Soon, Wang Qiang tempted Li Yi to photograph private parts for him to watch, and threatened to impersonate Li Yi with indecent photos of others if he did not meet his requirements.

Unable to withstand the threats, Li Yi repeatedly sent photos of his private parts to Wang Qiang on the gaming social platform.

Li Yi's mother, Ms. Zhang, discovered that there were a large number of photos of her private body parts in her daughter's mobile phone. She was shocked and found out the truth after questioning.

Ms. Zhang immediately called the police, and the public security organs opened the case for investigation. Due to the particularity of the case, the public security organs invited the prosecutors to intervene in advance.

After hearing the case report and reviewing the materials in the case, the prosecutors suggested that the public security organs lock Wang Qiang's identity through technical means, and pay attention to the collection of relevant evidence that can prove Wang Qiang's crime.

At the same time, further expand the scope of investigation to find out whether Wang Qiang has violated other minors.

The procuratorial organs issued successive procuratorial recommendations, urging the online game platform to rectify immediately.

During the police investigation, Wang Qiang confessed the facts of the crime and said that when he saw the first photo of the girl, he was judged to be a young girl.

On April 22, 2020, the case was transferred to Wuxi Yixing City Procuratorate.

After review, the court found that Wang Qiang's behavior seriously damaged children's personal dignity and mental health, and had the same social hazard as actual contact with children's private parts. It should be determined to constitute the crime of child molestation, and the decision was made to approve the arrest.

After the case was prosecuted, the court sentenced Wang Qiang to imprisonment for one year and six months for child molestation.

Although the case was settled, "a 9-year-old child could register for an online game account" made the prosecutor feel heavy.

In order to find out the facts in depth, the undertaking prosecutor did not handle the case, but sorted out the loopholes in the platform's supervision.

After investigation by the prosecutors, it was found that the game software involved in the case has nearly 50 million users who can log in through the default mobile phone number, WeChat, QQ, etc., and the age information can be arbitrarily modified; although the software has a youth mode, users still remain in this mode. Can log in from 22:00 to 8:00 the next day; the chat platform is not strictly audited, and illegal content such as obscene and pornographic photos can be uploaded freely.

According to the Law on the Protection of Minors, the Notice on Preventing Minors from Indulging in Online Games, Internet Information Service Management Measures, and other relevant regulations, a network technology company to which the game software belongs has real-name authentication settings, anti-addiction restrictions, platform content review, etc. There are management loopholes.

Based on this, the procuratorate has repeatedly communicated with the company on the rectification plan, and accurately formulated and issued procuratorial recommendations in terms of real-name registration of online game accounts, online game time used by minors, and supervision of user release information, and urged the company to perform statutory duties in accordance with the law.

"'Space' indecency is a new form of sexual assault on minors. It is different from traditional methods of physical contact. It has the characteristics of stronger concealment and wider harm." Jiang Yafang, a full-time member of the Yixing City Procuratorate, said, "From us Judging from the cases of indecent assault and sexual assault on minors handled through the air, minors are extremely vulnerable to deception and coercion during online games.

The prosecution reminded parents that they must guide their children to increase their awareness of self-protection. Once they find that their children have been illegally violated, they should promptly report the case to the public security organs and use legal weapons to protect their rights.
