Tattoos cause trouble

These teenagers are proud of their tattoos, are in the society, are aggressive, and even break the law.

  The People’s Procuratorate of Shuyang County, Jiangsu Province was responsible for reviewing and approving the arrest of Liu Ke’s case. Ye Mei, the deputy procurator of the court, discovered that Liu Ke had large areas of black and white impermanent tattoos on his arms and chest. The face looks out of place.

The dozens of other minors involved also had tattoos to varying degrees.

Large-scale tattoos of minors have appeared from time to time in other cases of gatherings to fight, provoking quarrels, and so on.

The tattoo industry is out of order

  After discovering the problem, the People’s Procuratorate of Shuyang County set up a minor public interest litigation prosecution team composed of professional backbones, from visiting infringing tattoo halls, going to relevant administrative agencies to collect evidence, talking with the minors and guardians involved, and searching for relevant laws and regulations Work in different areas.

The case-handling team had more than 70 conversations with the operators of the tattoo hall, 36 minors and guardians involved, and the attending physician, and collected more than 150 pages of relevant documentary evidence such as the personal information and industrial and commercial registration information of the infringing subject, and entrusted a professional institution to identify the extracted tattoo pigments Whether it is toxic and harmful.

  The investigation by the case handling team found that there are chaos and disorder in the tattoo halls and industry failures: many tattoo halls do not have any licenses, and the environment is generally dirty and messy; the source of the purchased paints and instruments is unknown, and the quality cannot be guaranteed; the disinfection awareness is not strong, extremely It is easy to bring the risk of infection of tattoo wounds and the spread of infectious diseases; some tattoo halls even carry out tattoo washing business illegally and are suspected of illegal medical practice; tattoo pigments submitted for inspection contain carcinogenic free formaldehyde components...

  The Shuyang County People’s Procuratorate found that the County Health Bureau and the Market Supervision Administration, as the competent authorities, did not perform their duties to supervise the practice of unlicensed operations in the tattoo industry and practice licenses from medical institutions.

  On October 31, 2020, the People's Procuratorate of Shuyang County issued an administrative public interest litigation pre-litigation proposal to the County Health Bureau and the County Market Supervision Administration.

The local health bureau and the market supervision administration attach great importance to it, and the county commerce bureau has carried out special rectification of the tattoo industry within the county.

As of March 31 this year, a total of 20 tattoo halls had been investigated under special rectification activities, two were ordered to close, six business scopes were changed within a time limit, 17 business licenses and health certificates were issued, and more than 200 legal risk warning letters were issued. Establish industry systems such as risk warning and identity verification.

Urgently need to unify standards and strengthen supervision

  During the special rectification process, deep-seated problems in the tattoo industry have also been exposed.

Ye Mei said that my country's current relevant regulations have blurred the standards for the classification of the tattoo industry.

  First of all, according to the National Bureau of Statistics "Resident Consumption Expenditure Classification", tattoos should be included in the beauty salon services; and according to the then Ministry of Health and the Ministry of Commerce issued the "Hygienic Regulations for Beauty Salon Places", beauty refers to non-invasive, non-invasive Sexual skin cleaning, maintenance and other services.

Obviously, tattoos are not part of life beauty because of their invasive characteristics.

Secondly, it is not clear whether the tattoo business place is a public place.

“At present, there is no tattoo industry in the scope of supervision of public places in Jiangsu Province, so it cannot be included in the scope of health license management.” said Yang Yong, leader of the law enforcement brigade of Shuyang County Health Bureau. “Enforcement dilemmas exist all over the country and there is no clear supervision. This has also led the local health bureau and market supervision administration to believe that there is no basis for administrative punishment for tattooing minors.

The investigation found that not only Shuyang County, but some surrounding cities and counties also had minor tattoos.

  According to Zhang Haitao, the chief prosecutor of the People's Procuratorate of Shuyang County, in order to make up for the lack of legislation, the procuratorate decided to initiate a civil public interest litigation procedure and pursue the liability for infringement of the tattoo hall.

  From its opening on June 1, 2017 to April 2020, the procuratorial organs intervened in the investigation. Six to seventy percent of the tattoo shops operated by Zhang were from minors, and at least hundreds of minors had been tattooed.

On December 25, 2020, the People's Procuratorate of Shuyang County filed a civil public interest lawsuit against Zhang and made an announcement.

The prosecution review has been completed, and a lawsuit will be filed soon.
