China News Service, Nanchang, April 20 (Reporter Li Yunhan) The People’s Procuratorate of Jiangxi Province held a press conference on the 20th to report that in the past year, Jiangxi’s prosecutors have handled 398 cases of supporting migrant workers’ prosecution and helped migrant workers recover their wages and debts. The salary is more than RMB 6.819 million.

According to Luo Jun, the second-level senior prosecutor of the People’s Procuratorate of Jiangxi Province and the director of the Sixth Prosecution Department, from May 2020 to the end of March this year, Jiangxi’s procuratorate handled 398 prosecution cases against migrant workers, a year-on-year increase of 5.9 times. 9 cases of civil effective judgment and supervision of wages were handled, and 20 civil enforcement supervision cases involving the rights and interests of migrant workers were handled. Comprehensive use of support for prosecution, protests, and procuratorial suggestions helped migrant workers recover more than RMB 6.819 million in wages and owed wages, effectively resolving conflicts Disputes, safeguard the legitimate rights and interests of the people, and promote social harmony and stability.

It is understood that the People's Procuratorate of Jiangxi Province took the initiative to strengthen communication with the Jiangxi Provincial Office of Indebtedness Management, the Provincial Labor Inspectorate and other departments, reached a collaborative consensus on the eradication of wage arrears for migrant workers, and worked together to promote the implementation of the special action to eradicate wage arrears.

Procuratorates at the city and county levels actively establish working mechanisms with courts at the same level, judicial, civil affairs, letters and visits, human resources and social security departments, trade unions, and disabled persons' federations to continuously optimize the internal and external environments that support prosecution work.

Since May 2020, Jiangxi procuratorial organs have taken overall consideration of the prevention and control of the new crown epidemic and economic and social development when handling migrant workers’ wage claims, so as to protect both employment and people’s livelihood as well as market players, actively coordinate units that are in arrears of wages, and facilitate both parties to prosecute. 146 cases were closed in the former settlement method, which enabled efficient resolution of the cases, reduced the burden of litigation by the parties, and realized income for migrant workers and gains for work as soon as possible.

Luo Jun said that Jiangxi's procuratorial organs helped migrant workers to rationally defend their rights by supporting the parties to file civil lawsuits in the courts in accordance with the law, and guide the migrant workers to file lawsuits in the courts if they meet the conditions for prosecution after reviewing the wage claims cases they have accepted. Appeal, seek compensation.

During the court hearing, the procuratorial agency took the initiative to strengthen communication with the court, and jointly facilitated the settlement of 127 cases by both parties through mediation; continued attention to the implementation of court judgments and mediation documents, and urged the court to implement 20 cases.

It is worth noting that Jiangxi's procuratorial organs actively formulate and issue procuratorial suggestions for improving work and governance in conjunction with the common and tendentious issues found in handling migrant workers' wage claims, and promote the establishment of rules and regulations by relevant departments.

Luo Jun gave an example that the People’s Procuratorate of Nanchang Economic and Technological Development Zone found that a certain industrial town’s construction project had serious wage arrears and that a real estate company failed to allocate labor costs to migrant workers’ wages in a timely manner. Account, the construction unit failed to pay about 720,000 yuan to more than 70 migrant workers in a timely manner. The procuratorial agency submitted procuratorial recommendations to the district labor inspection bureau in accordance with the relevant provisions of the "Regulations on Guaranteeing the Payment of Migrant Workers’ Wages," and suggested strengthening the implementation of labor inspection and law enforcement. The special account system prevents and reduces the occurrence of wage arrears for migrant workers. (Finish)
