So far, the chain of sales of counterfeit medicines spanning Shandong, Henan and Anhui has been successfully cut off for 5 years.

The "magic medicine" of his father's business

  Enter the Lubei market

In the late 1990s, when a rural doctor from Nanyang, Henan, "Dr. Li" moved to Boxing, Shandong to practice medicine, he claimed that the homemade pills with "secret recipes from the ancestors" had miraculous effects on diseases such as asthma, rheumatism, and waist and leg pain. He got acquainted with the local area. The two villagers Bai Botao brothers.

The two brothers run a small spray paint workshop. Due to long-term exposure to pungent odors, Bai Botao's brother has been suffering from asthma for many years. After taking "Dr. Li" pills, his symptoms quickly healed.

Since then, the two parties have left phone numbers for each other, and Bai Botao has also left a memory of "magic medicine" in his mind.

In the early spring of 2005, Li Wen, the son of "Doctor Li", worked as a salesman in a winery in Henan, and traveled frequently due to work needs.

By chance, he met Bai Botao's wife and nephew, and revealed that he possessed a "magic medicine" made with "secret recipes from ancestors."

Because of the previous relationship, Li Wen quickly got in touch with Bai Botao and hoped that the two brothers could "make a name for him".

After the Bai Botao brothers spared no effort in publicity, a series of rumors about Li Wenhe's "Ancestral Secret Recipe" quickly spread in surrounding villages.

People suffering from asthma, rheumatism, waist and leg pains and other diseases entrusted Bai Botao to buy "magic medicine" from Li Wen. In this way, Li Wen opened up the market in the northern Lubei village.

Limited by the conditions at the time, whenever the "magic medicine" Bai Botao needed reached a certain amount, Li Wen would take the medicine and rush from his hometown of Henan to Boxing, Shandong, and personally visit his door.

  Courier "shipping" in different places

The sales chain is gradually improving

In the early autumn of 2005, Li Wen met Guo Mingliang, a vegetable farmer in Fuyang, Anhui, on his way to the winery business.

Knowing that Guo Mingliang had the "old cold legs" problem, Li Wen gave the "magic medicine" he carried with him free of charge, and begged him to help spread the reputation of the "magic medicine"; if the neighbors buy the "magic medicine" "For the demand, Guo Mingliang also helped to find Li Wen to buy.

The two also formed a deep friendship.

Since 2015, the express delivery industry has developed vigorously. At the same time, relevant law enforcement agencies in Henan Province have also increased the control of counterfeit drugs.

Upon seeing this, Li Wen and Guo Mingliang came up with an idea to transfer the sales address and develop "online" business.

Before each transaction, Li Wen and the "customers" from other provinces agreed in advance the name and quantity of the "magic medicine", and then sent it from Henan to Anhui by consignment of cosmetics or daily necessities.

After receiving the "magic medicine", Guo Mingliang acted as a "transit station", and according to the information provided by Li Wen, the goods were shipped separately to the outside world.

Bai Botao is the common "next home" of Li Wen and Guo Mingliang.

In order to avoid detection by law enforcement agencies, Bai and Li agreed in advance to conduct a transaction every six months.

In each transaction, Guo Mingliang will complete the packing according to the prior agreement.

In this way, a "magic drug" sales chain spanning the three provinces of Henan, Anhui, and Shandong has gradually taken shape.

Uncover the "magic drug" production process

  The truth is shocking

What is this "magic medicine" and how is it "produced"?

It turned out that Li Wen first purchased a batch of "raw materials" in bare bottles containing 100 tablets at a cost price of several yuan, and then "secondary processing" on them-contact the print shop to customize the "magic drug" label. Privately forge the name of the drug, approval number, and production unit, and at the same time tailor a "drug instruction sheet" for the "magic drug", marking the name of the drug, patient groups, drug ingredients, and precautions.

The "magic medicine" that has undergone secondary processing has no difference in appearance from the medicines sold in pharmacies, and it is enough to be fake.

Subsequently, Li Wen sold it to Bai Botao at a price of 13 yuan per bottle.

After identification, the "magic medicine" produced by Li Wen mainly comes from "High-efficiency Fengshining Capsules" and "Compound Chuanling Dingchuan Capsules".

Both types of drugs are marked with the words "produced and developed by the Institute of Rheumatism and Asthma, Taiqian County, Henan Province".

It is reported that the above two types of drugs were once called "disease-resistant drugs" by patients.

In September 1998, the batch numbers of the two types of drugs were revoked because they contained prohibited ingredients. They were banned by the state. The main ingredients of the drugs are prednisone acetate, ibuprofen, diclofenac sodium and other hormones, which have analgesic properties. effect.

These kinds of pharmaceutical ingredients, because they rely on hormones to control diseases and have analgesic effects, will give patients a "very effective" illusion.

And Li Wen is also relying on this "magic medicine" with obvious pain-relieving effects to bluff a lot of people who don't know the truth.

In accordance with the relevant regulations of national medical management, the above-mentioned drugs are for specific patient groups and need to be taken in strict doses, and there are corresponding contraindications and precautions.

If such drugs are taken for a long time, it will not only delay the diagnosis and treatment of the disease, miss the opportunity for early treatment, but also may cause serious complications such as endocrine disorders.

  Criminal with civil

  Prosecutors double "bright swords"

According to the confession of Li Wen and others, from December 2015 to May 2019, on this illegal counterfeit drug sales chain that lasted for many years, Bai Botao purchased a total of 48,100 yuan and sold "magic drugs" to the surrounding people. More than 3000 bottles.

After the "magic drug" was in hand, Bai Botao, in addition to being partly used to treat his own asthma, added an additional price difference of about 2 yuan per bottle to make a profit from it. Guo Mingliang, as a "middleman", also made a profit of nearly 30,000 yuan from it. .

Gao Xiaoshan, a farmer in Boxing, Shandong, was one of the victims of the "magic medicine."

In May 2019, in order to help his grandfather treat his asthma, Gao Xiaoshan asked someone to purchase several bottles of "magic medicine" from Bai Botao.

However, Gao Xiaoshan's grandfather did not get any relief after taking the medicine.

With doubts in mind, he searched the Internet for the manufacturer and approval document number marked on the "magic medicine", and was surprised that the "magic medicine" had neither a related manufacturer nor a corresponding approval document number.

He immediately reported the case to the public security organ.

After the case was filed and pursued by the public security organs, Bai Botao, Li Wen, Guo Mingliang and others were all arrested and brought to justice.

After arriving in the case, the above three confessed to their crimes.

In December 2020, the Boxing County Public Security Bureau transferred the case to the Boxing County Procuratorate for review and prosecution.

"For the case of counterfeit drug sales, we must not simply judge it!" In the process of handling the case, the prosecutors strictly reviewed and visited Bai Botao Radiation's "sales area" many times, looking for multiple victims to verify, and further fixed the case. Chain of evidence.

Prosecutors analyzed that the sale of counterfeit drugs had affected the health of many victims.

In January of this year, the Boxing County Procuratorate filed a criminal incidental civil public interest lawsuit against the defendant Li Wen and others on suspicion of selling counterfeit drugs, demanding that the three defendants pay three times the amount of counterfeit drugs sold while pursuing criminal responsibility. Punitive damages of 144,300 yuan, and a public apology in the media.

A few days ago, the court made the above judgment after trial.

The three defendants expressed their obedience to the judgment in court and did not appeal.
