Repeatedly sitting on the ground and raising prices, some customers were forced to pay 16,000 yuan

"Beijing Sifang Brothers Moving" was sued

A few days ago, Beijing Sifang Brothers Moving Co., Ltd. and its legal representative, actual controller Zhao Mouqiang, and 5 vehicle team leaders were accused by the prosecution of forced trading crimes and were prosecuted to the Chaoyang Court.

There were more than 40 forced transactions alleged in the indictment, and the total amount involved was more than 130,000 yuan, and the maximum amount in a single transaction reached 16,000 yuan.

The asking price rose from 1,200 yuan to 18,000

Last July, Ms. Wu from Beijing contacted "Beijing Sifang Brothers Moving Co., Ltd." to move.

According to the agreement between the two parties, a vehicle is 400 yuan, plus a distance fee of 200 yuan. The disassembly and assembly costs are included in it, and the entire moving cost is about 1,200 yuan.

But at the checkout, Ms. Wu was dumbfounded, and the bill from the moving company was 18,000 yuan.

According to the explanation of the moving company, the cost of each mover is 300 yuan, for 7 hours of work, 2100 yuan per worker, a total of 13,000 yuan, plus the distance fee, a total of 18,000 yuan.

Ms. Wu couldn't accept this fee, and after discussing it, she finally paid 4000 yuan.

However, Ms. Wu posted the matter on the Internet, which caused a lot of attention.

Subsequently, law enforcement officers of the Chaoyang Branch of the Beijing Municipal Market Supervision Bureau monitored the situation and launched an investigation.

According to the investigation, the company did not actually operate at the registered address, but rented a simple house in a village to undertake the moving business.

In other words, the "Beijing Sifang Brothers Moving Co., Ltd." that Ms. Wu looked for was an impersonation "Beijing Brothers Moving Co., Ltd." for moving services.

The suspect has arrived in August last year

Coincidentally, in August last year, the Chaoyang police in Beijing received an alarm from the masses. A moving company called "Beijing Sifang Brothers" declared that the price was low before receiving the order, and there were no other additional costs, and then urged the customer to sign the implied sign on the grounds of moving quickly. Contract with additional cost clauses.

In the moving process, the mover sits on the ground and raises the price, asking for extra high labor costs on the grounds of the contract, and at the same time threatening verbally, saying that he will not leave if he doesn't pay, and he stays at the customer's home.

After preliminary inspection by the police, the company has forced 26 victims to pay additional costs totaling more than 50,000 yuan.

In the process of moving the goods from the departure place to the truck, the movers used various reasons such as urging the victim to move quickly, and asked the victim to sign a contract with implied additional cost clauses without clearly seeing the content of the contract.

However, after arriving at the destination, the porter asked the victim to pay a labor fee much higher than the basic moving fee (300 yuan per person per hour) in accordance with the content of the contract, and used "soft violence" methods such as verbal threats and threats to take away the goods. Ask for money.

After fully grasping the organizational structure of the criminal gang, the division of labor and the law of committing crimes, the Chaoyang police arrested the gang on August 11, 2020. They will be arrested in Dongcheng, Fengtai, Fangshan and other places. Gang members headed by Qiang (male, 24 years old) were arrested in one fell swoop.

At that time, 21 people including Zhao Moqiang were detained by Chaoyang police in accordance with the law on suspicion of forced trading.

  More than 40 forced transactions

Recently, Beijing Sifang Brothers Moving Co., Ltd., its legal representative and actual controller Zhao Mouqiang, and 5 vehicle team leaders were accused by the prosecution of forced trading crimes and were prosecuted to Chaoyang Court.

The indictment alleges that Beijing Sifang Brothers Moving Co., Ltd. committed more than 40 forced transactions, involving a total of more than 130,000 yuan, of which the highest single transaction reached 16,000 yuan.

According to Zhang Long, deputy director of the Second Procuratorate of the Beijing Chaoyang District Procuratorate, the defendant Zhao Mouqiang is the legal representative and actual controller of Beijing Sifang Brothers Moving Co., Ltd.

In order to grab illegal benefits, from July 2019 to July 2020, it promoted Beijing Sifang Brothers Moving Co., Ltd. through 58.com, Baidu and other platforms.

He reached an verbal agreement with the customer over the phone and agreed on the moving cost. After arriving at the scene, he instructed the team leader and the mover to unilaterally increase the moving price, and concealed the written moving cost of 300 yuan per person per hour.

During the handling process or after the handling is completed, by means of stopping the handling or verbal threats, ask for a fee much higher than the originally agreed price, and force the customer to accept the specified service.

"Zhao Moqiang and others have repeatedly said that we are porters and we are implementing a normal trading behavior. During this process, we encountered a lot of resistance. The task force actively carried out interpretation and reasoning work, and forced the transaction. The constitution of the crime was analyzed. For example, they forced customers to accept their services and paid their prices at prices that customers did not want to accept. This is an act of forcing transactions.” In the end, according to the suspect’s confession, Witness testimony, Alipay, WeChat transfer records and other evidence, the prosecutor charged more than 40 criminal facts, all suspects pleaded guilty and punished.

In addition to the six defendants indicted, according to the criminal policy of both leniency and strictness, the prosecution also dealt with relative non-prosecution of the remaining personnel.
