At the end of last year, the Ministry of Industry and Information Technology issued the "Minimum Necessary Evaluation Specifications for the Collection and Use of Personal Information by APP", which stipulates the minimum necessary specifications and evaluation methods for the collection, use, storage, and destruction of facial information by mobile applications.

In addition, in the Civil Code, biometric information is clearly listed as personal information, but there is no special protection for personal biometric information.

  Liu Wei believes that, in general, China's legislation and regulations on personal biometric information such as facial information are constantly improving, but they are not comprehensive and clear enough.

Due to insufficient regulations and management constraints, relevant development and application units obviously lack security initiative and sense of responsibility in information protection, identity authentication and other technologies.

  Zhang Guiping proposed that the collection and recognition of facial information must have a clear legal basis or be clearly authorized.

Authorized agencies shall not exceed the personal and public interests of the authorized subject when using information, and shall not transfer personal biometric information without permission.

  Yu Xinwei believes that the public security department can undertake the approval and supervision functions of face recognition applications.

Office buildings, shopping malls, enterprises, etc., as well as parks, schools, etc., should apply for approval before applying face recognition technology, and strengthen the necessity of application scenarios. For approved facial recognition applications of non-specific groups such as shopping malls, they must The distinctive sign informs the counterparty.
