Related information has spread rapidly on Weibo and other online platforms, causing bad social effects.

On February 20, the criminal suspect Qiu Moming was detained by the public security organs, and the People's Procuratorate of Jianye District, Nanjing City intervened in the investigation according to law.

On February 25, the public security agency submitted a request to the procuratorate to approve the arrest on suspicion of creating disturbances.

  The prosecutors found that the criminal suspect Qiu Mouming used the information network to demean and ridicule heroes and martyrs, infringe on the reputation and honor of heroes and martyrs, and had a bad social impact and serious circumstances.

According to Article 299 of the Criminal Law of the People’s Republic of China, the People’s Procuratorate of Jianye District, Nanjing City approved the arrest of the criminal suspect Qiu Mouming on charges of infringing on the reputation and honor of heroes and martyrs.

  Heroes and martyrs use their blood and lives to defend the territory of the motherland, and their reputation and honor cannot be slandered.

The "Law on the Protection of Heroes and Martyrs of the People's Republic of China" and the "Civil Code of the People's Republic of China" clearly stipulate that actions that infringe upon the reputation and honor of heroes and martyrs shall bear corresponding civil, administrative and criminal liabilities.

  The "Amendment to the Criminal Law of the People's Republic of China (11)" implemented on March 1, 2021 clearly stipulates the crime of infringing on the reputation and honor of heroes and martyrs.

According to the first paragraph of Article 12 of the Criminal Law of the People’s Republic of China, the criminal suspect Qiu Mouming violated Article 35 of the Criminal Law Amendment of the People’s Republic of China (11), infringing upon the reputation of heroes and martyrs. Honor, which seriously damages the personal dignity of the heroes and martyrs who defend the border, seriously damages the image of soldiers defending the border, and harms the public interests of the society, and should be prosecuted in accordance with the law.

  At the same time, in order to protect the legal rights and interests of heroes and martyrs, with the support and cooperation of military procuratorial organs, Nanjing procuratorial organs decided to open public interest litigation and conduct investigations.
