  • While the idea of a "vaccine passport" to limit the spread of the coronavirus worries the public, a resolution of the Parliamentary Assembly of the Council of Europe is enjoying some visibility online.

  • Adopted at the end of January 2021, this document recalls in particular that vaccination is not compulsory and that no one can be encouraged to be vaccinated in the event of refusal.

  • If this resolution is authentic, many Internet users are questioning its legal value with regard to national vaccination strategies.

Did the Council of Europe expect to see its “ethical, legal and practical considerations” around the vaccine against Covid-19 arouse such interest from Internet users?

This “resolution 2361”, adopted by the Parliamentary Assembly of this European body on January 27, has in any case been talked about a lot on social networks since it was put online.

And for good reason: while many citizens are worried about the hypothetical implementation of a “vaccine passport” in France (or at European level), this resolution recommends, to ensure a “level of acceptance high levels of vaccines ”, the importance“ of ensuring that citizens are informed that vaccination is NOT mandatory and that no one is under political, social or other pressure to get vaccinated, if he or she does not wish to do it personally ”.

As a result, the resolution is relayed as much by Internet users reassured by this reminder as by others, who remained suspicious.

“Tired of seeing this famous resolution 2361 circulating […] that the vaccine would not be compulsory !!!

[…] It is written in red: PROVISIONAL !!!!

And even if this resolution is not provisional: they do what they want and backpedal constantly with laws, decrees, proposals for laws, health measures, etc.

»Alarmed, for example, an Internet user recently, when others are simply wondering about the legal scope of such a decision.

FAKE OFF

“The word 'provisional' is simply mentioned because the text is still awaiting proofreading.

But on the substance, on the substance, nothing will change, and this mention must disappear relatively quickly ”indicates to

the Parliamentary Assembly of the Council of Europe (PACE) - confused by some Internet users with the European Parliament.

“The Assembly brings together parliamentarians [deputies, senators] from the 47 member states of the Council of Europe - including, of course, France and the other countries of the European Union, but also Turkey, Russia and countries of the Caucasus.

Its resolutions are not legally binding on the 47 states of the Council of Europe, or on the European Union, ”says PACE.

However, the body recalls its reputation as the “democratic conscience” of Europe and the fact that “its positions carry moral value at the international level”: “They have an indirect influence on national legislation since the same parliamentarians grouped together in of the Assembly vote - in their parliaments - on national laws.

The Assembly speaks on behalf of 830 million Europeans, through their parliaments, and its positions therefore have a significant influence in debates within the EU.

"

No compulsory vaccination in France, except in certain cases for children

As a reminder, in France, certain vaccines are recommended and others compulsory for children, in particular against tetanus and diphtheria.

In practice, therefore, the State cannot oblige refractory parents to have their child vaccinated, but the latter may be refused access to the crèche or any reception structure if he has not received the one of the eleven compulsory vaccines.

“States remain sovereign on the issue of vaccination.

The only possibility for a binding obligation, within our organization, would be a judgment of the European Court of Human Rights, which is not at all in question at the moment.

An individual would have to file a complaint against one of the countries concerned for the violation of his rights, and that the judgment be in his favor, ”concludes the PACE.

In France, Emmanuel Macron has repeatedly repeated his opposition to compulsory vaccination against Covid-19.
