The Higher Administrative Court for the state of North Rhine-Westphalia has overturned the obligation to wear an everyday mask in the retail environment.
On Wednesday, the OVG rejected the urgent application by a woman from Gelsenkirchen against the general mask requirement.
According to the announcement, the court found the woman right on one point.
The currently valid Corona Protection Ordinance prescribes the wearing of everyday masks in the retail environment.
This means parking spaces in front of grocery stores or routes to the store.
The term “immediate surroundings” is too vague for the OVG.
It therefore temporarily suspended the regulation on this point.
This order can not be contested.

The wording in the regulation allows for multiple interpretations.
This could mean a radius of a few meters around the entrance area, but also a larger area with an area of 50 meters, such as the ban on eating out of the house.
The 13th Senate of the OVG criticizes that this lack of clarity weighs particularly heavily, because a violation of this mask requirement could result in a fine.
