The Court of Instruction number 3 of Zaragoza has summoned the cook and television presenter

Alberto Chicote

to testify

for alleged

coercion.

He has been denounced by the owner of a Chinese restaurant in the Aragonese capital in which the chef and host of the program

Heraldo de Aragón,

the owner of the restaurant maintains that he

authorized the entrance of the cameras, but only to the part where the public is served

and accuses Chicote of sneaking into the kitchen without permission, as well as opening all the cabinets and the refrigerator.

He assures that, despite his warnings not to do so, the presenter used a handheld camera to record the food that was inside a freezer and even the documentation that he gave to the municipal police.

Therefore, he went to a police station and filed a complaint for alleged coercion.

Chicote denied in court, through various writings, having personally recorded anything.

The complainant's lawyer, Patricia Rodrigo, requested the prohibition of the emission of said images.

Caution

The magistrate of the aforementioned court decided to attend the petition and on February 26, 2020 issued an order agreeing the adoption of the precautionary measure "in order to protect the victim and avoid irreparable damage to the same, without prejudice to what may result after the prosecution of the facts ".

The judge communicated her decision to Alberto Chicote, but, as the controversial images belonged to Quartz Producciones S. L, in September an official request was also made to him to

refrain from issuing the graphic material obtained in the aforementioned Chinese restaurant .

The producer challenged the injunction, but, nevertheless, first the court and later the Provincial Court of Zaragoza rejected her appeal.

According to

Heraldo de Aragón,

the Third Section of the Hearing, when rejecting the claims of the production company, points out that "the decision to adopt a precautionary measure such as the present one is not unfortunate in the event of a conviction that prevents the emission of the images recorded and whose broadcast has been expressly prohibited, and this because the possible existence of damages affecting a natural person, with the repercussions that it would entail for the operation of their business, cannot be ignored, before the emission of images that a television station broadcasts national in scope ".

It adds that "

a weighted balance needs to be struck between freedom of information and the right to property."

On the other hand, the producer managed to get the judge to impose a surety on the complainant, as a guarantee, to answer for the alleged damages by not being able to broadcast the images.

Initially he requested 110,000 euros, but the magistrate considered it disproportionate and reduced the amount to 6,000 euros, a sum that the complainant has contested and on what the Hearing will have to rule.

The complaint has been processed as a possible misdemeanor of coercion, so that, in case of conviction, Alberto Chicote would only have to pay a fine.

However, in

the trial to be held next March

in the City of Justice of Zaragoza, it will also be decided whether or not the images in question can be broadcast.

unsanitary conditions of a Chinese restaurant

to the Local Police of Zaragoza

"Conditions that will end with the Police closing the restaurant with Chicote."

When he arrives at the restaurant, the first thing the chef blurts out is "'Holy Virgin!", Seeing stoves full of dirt, unrefrigerated food, food on the counter without any treatment and "a lot, a lot, a lot of shit."

And he adds: "There is the food, here the eggs and there the bugs. If I were a bug I would also want to come here because

this is the paradise of the bug."

At one point, Chicote gives one of his reprimands to the owner of the restaurant when he sees that he defrosts some prawns to flour and once they are already flour he freezes them again.

"It is forbidden to use a can of preserves as a container to freeze, and above with the meat and the unpackaged product.

I have the great fortune of never having ordered food here," he

already points out with the police in the restaurant kitchens.

It is the agents themselves who announce to the owner that he has to

close the kitchen of his restaurant immediately

and that they are going to seal it up for having everything in poor condition.

One of them even tells him that "a Health veterinarian will come and we will close it".

The astonishment of the agents and Chicote is great when they see the conditions of the restaurant.

"This is

a shit pit

where you cannot prepare anything that people will eat, because this is the only thing that looks good in the whole restaurant, which is what the customer receives (and they do not know where it has been prepared all this) ", says the chef while showing a lunchbox of rice three delights that was to be sent to a home address.
