The Department of Justice of the Hong Kong Special Administrative Region subsequently appealed the decision of the High Court, and the Court of Final Appeal granted permission to appeal and a temporary detention order.

On February 1, the case was heard in the Court of Final Appeal. After hearing the statements of both parties, the judge decided to adjourn the sentence and Li Zhiying must continue to be remanded.

  Zhou Tianxing, the acting deputy prosecutor of the Department of Justice, said that the focus of the hearing was on how to correctly interpret and apply Article 42 of the Hong Kong National Security Law.

The court should first consider Article 42(2) of the Hong Kong National Security Law, which states that "a criminal suspect or defendant shall not be granted bail unless the judge has sufficient reason to believe that they will not continue to commit acts endangering national security."

  Zhou Tianxing said that when deciding whether to approve bail, the court should consider whether there is a risk of repeat offenders and reiterate that maintaining national security is the top priority.

  It is reported that the five designated judges responsible for the case are Chief Judge Zhang Juneng of the Court of Final Appeal, permanent judges Li Yi and Huo Zhaogang, and non-permanent judges Chen Zhaokai and Situ Jing.
