The second trial of the "wrong life for 28 years" case will open, the lawyer: mental damage compensation is the focus

  On January 25, The Paper (www.thepaper.cn) learned from Yao Ce and his biological parents' attorney Zhou Zhaocheng that the second instance of the "28 years of wrong life" case will be held at the Kaifeng Intermediate People's Court in Henan on the 26th.

Yao Ce's biological mother Du Xinzhi and biological father Guo Xikuan arrived in Kaifeng on the morning of the 25th, preparing to participate in the trial tomorrow.

  Zhou Zhaocheng told The Paper that the focus of the trial was on the amount of compensation for mental damage, and Yao Cefang submitted multiple key pieces of evidence.

  The Paper previously reported that on February 17, 2020, Yao Ce, a 28-year-old young man from Jiujiang, Jiangxi, was diagnosed with advanced liver cancer. His adoptive mother, Ms. Xu, decided to cut the liver and save her son, but found that she was not related to her son.

Later, I learned that Ms. Xu and Du Xinzhi had the wrong child because of the mistakes of related personnel during the delivery in the Huaihe Hospital of Henan University in 1992.

28 years later, the fate of the two families was intertwined due to Yao Ce's illness.

  On July 23, 2020, Yao Ce and his biological parents filed a lawsuit against Huaihe Hospital of Henan University for infringement.

  On December 7, 2020, the first-instance judgment was pronounced in the "28 years of wrong life" case.

The People's Court of Gulou District, Kaifeng City ruled that Huaihe Hospital of Henan University compensated Yao Ce and his biological parents for a total of 760,000.

On December 28, 2020, Yao Ce and his biological parents filed an appeal.

  On January 10, 2021, Yao Ce's condition suddenly deteriorated. He was issued a "critical illness notice" and the hospital rescued Yao Ce.

On the 13th, Zhou Zhaocheng told The Paper that Yao Ce is still in the observation period and the situation is slightly better than before.
