Egypt ... "The marriage of experience" is an issue that raises controversy ... Al-Azhar rejects and the "fatwa" is studying the matter

The legal researcher in the Al-Azhar Sheikhdom in Egypt, Sheikh Abu Al-Yazid Ali Salama, stressed the sanctity of "trial marriage," noting that whoever promotes this marriage "seeks fame and public follow-up."

The case of Masmi as "trial marriage" has turned into a public opinion issue, with hundreds of thousands of Egyptians and the Arab world interacting with her arguments, especially after tweeters circulated pictures showing copies of "experience" marriage documents, which confirms the existence of such cases and that it is not just an issue at hand. For discussion.

The idea of "trial marriage" is based on the principle that "a civil contract shall be signed stipulating that the marriage period be set for a specific period, which is a year, two years, or more, according to conditions that the spouses place in the contract, where they can stay with their families, and set a date for a meeting," Provided that the divorce takes place after the expiry of the specified period. "

Abu Al-Yazid Ali Salameh warned that "those who promote these ideas seek fame and obtain public follow-up, so meet God and do not trade in people's pain, so it is not permissible for us to follow the forbidden path to achieve the goal, as these ideas do not satisfy God, nor the Messenger of God, not even society." .

The researcher at Al-Azhar Sheikh has expressed his astonishment at this issue, and pointed out that "it is customary for a person to rent an apartment for a specific period, so is it possible for a person to rent another person for a specific period?"

Abu Al-Yazid Ali Salama explained, according to Al-Masry Al-Youm and Al-Youm Al-Sabea that “it is permissible in a legal marriage contract that there are conditions, but there are two types of conditions, such as the wife’s condition on the husband when marrying the other, which is permissible, and as for the stipulation of The term of the contract, this nullifies the contract from the beginning, because it contradicts the meaning of marriage.

Al-Azhar International Fatwa Center issued a statement describing the marriage of experience as “a corrupt condition that has no significance,” adding that “stipulating the termination of the marriage contract at the end of a certain period makes the contract void and prohibited.”

Al-Azhar continued, according to the BBC, commenting on the image of the contract in circulation, saying that it "contradicts the foundations of the marriage system in Islam, and clashes with its provisions and purposes, in addition to the abuse of women it contains."

The Egyptian Dar Al Iftaa has not yet come out with a clear statement, but it announced, according to the BBC, that "the initiative in all its details is under discussion to study it in all its legal, legal and social aspects, and to find out the correct legal opinion," adding that the official opinion will be announced as soon as the committees finish the study.

Since the end of last year, an Egyptian lawyer began to apply the idea of "trial marriage", which he says is the "most appropriate model for this stage", and aims "to limit the spread of divorce in the Arab community, through commitment and preserving the family and excluding divorce as a solution to any of the problems facing Spouses in the early years. "

In a previous interview with the BBC, lawyer Ahmed Mahran said that he was inspired by the "movable list", which is one of the famous Egyptian customs before marriage, in which the ownership of each of the spouses is documented in pieces of furniture, electrical appliances, or the like, and the husband signs a list The movables and he declares that he is obligated to return them if requested to do so.

Likewise, Mahran proposed the idea of a legal contract attached to the marriage contract that includes immaterial conditions agreed upon by the spouses before marriage, to act as a legal deterrent in the event that one of the parties does not comply with those conditions.
