The culprit was found not guilty after three years of grievances

　　After running for 3 years, the 40-year-old Wu Shuang finally got his innocence verdict on December 25, and it has been four and a half years since that unforgettable late night. (For details, please refer to the report "Proof of Guilt" ").

　　In the middle of the night on June 12, 2016, when Wu Shuang drove a truck through the vicinity of Woluogu Middle School in Yutian County, Tangshan City, he almost hit a man in the middle of the road.

Soon after, someone found a man lying on the road with a large blood stain beside him.

After the police car and ambulance arrived, the man was dead.

Wu Shuang was identified as the perpetrator and sentenced to 1 year and 4 months in prison.

　　Three years after being released from prison, Wu Shuang finally got rid of his suspicion of causing the accident, but the cloud of suspicion that hung in front of Woluogu Middle School has not yet dissipated.

Incident

　　No one knows why Liu Maosheng left home that night.

　　Father Liu recalled that the night before, Liu Maosheng had a meal with a few friends and went out to play after the meal.

At that time, the old couple lived in a fish pond. At night, Father Liu was worried about his son, so he went home at 0:10 to take a look.

He remembered that his son was in front of his house and his car was parked in front of his house.

Father Liu did not speak to his son and went back to the fish pond.

　　At around 5 o'clock in the morning the next day, Mother Liu was worried about her son and urged her wife to go home again.

Father Liu found that the stereo at home was still on, but his son was not there.

　　Several friends who had dinner with Liu Maosheng that day remember that Liu Maosheng drank four or five cans of beer and went home at 11:40 in the evening.

Later, they heard that Liu Maosheng had an accident.

　　At midnight on June 12, 2016, Wu Shuang, a truck driver, carried more than 20 tons of cargo to Tianjin. When he was driving on the Tangtong Highway, he saw someone in the middle of the road and suddenly stepped on the brakes and turned, awakening his sleeping wife.

After Wu Shuang drove forward for a while, he stopped the car to check the tires, confirmed that there were no blood stains, and continued on the road.

　　At 2:30 at night, when Li Yong, who drove a van to Tangshan, was passing by Woluogu Middle School, he found a man in a black vest lying on the road with a lot of blood beside him. Li Yong called the police.

When the police and ambulance arrived at the scene, the man had died.

　　The man in the middle of the road was later confirmed to be Liu Maosheng, a villager in Woluogu Town.

judgment

　　At first, Li Changqing, Wu Shuang's attorney, was afraid to confirm whether Wu Shuang had hit someone. The only thing he could be sure of was that there was insufficient evidence to find Wu Shuang guilty.

　　On June 16 and 17, 2016, the police entrusted Wu Shuang's vehicle (or its extracts from the vehicle) and related items of the deceased to the Beijing Mingzheng Judicial Appraisal Center and Tangshan Material Evidence Judicial Appraisal Center for appraisal, and then commissioned Shenyang Motor Vehicle Accident The judicial appraisal institute verified the correspondence between Wu Shuang's vehicle and the traces of the deceased's pants.

　　Although two of the above three judicial appraisal reports gave the conclusion that they were “undetected” and “unsure”, the Yutian Traffic Police filed an investigation on Wu Shuang on August 25, 2016 and detained him until September. 1st.

A week later, Wu Shuang was formally arrested.

At that time, the main evidence that Wu Shuang was found guilty was the vague tire pattern on the clothes of the deceased and the "suspected human tissue" on Wu Shuang's tires.

　　Li Changqing came to the scene of the accident three times to record nearby surveillance equipment and request surveillance video.

At the end of 2016 and the beginning of 2017, after Li Changqing got a few surveillance videos, he thought the matter was basically clear.

　　At 2:20 that night, the truck driver Zhang Chunhua also drove the truck across the road.

Two days after the aforementioned accident, Zhang Chunhua made the first confession. He said that he saw a man in black sitting on the road.

　　The surveillance video of Woluogu Middle School showed that Zhang Chunhua's vehicle appeared at 2:20 at night, and the informant Li Yong's van appeared at 2:30.

The traffic accident that led to Liu Maosheng's death occurred within these 10 minutes.

The Wu Shuang truck appeared on the surveillance at 2:19.

　　In May 2017, the Yutian County People's Court opened a court session to hear the case.

In June of the same year, the witness Zhang Chunhua recorded a second statement. The statement showed that he changed his statement and said that he did not remember whether the person on the road was sitting or lying down.

　　In the judgment of the Yutian County People's Court on December 8, 2017, surveillance video evidence was not included.

The court found Wu Shuang guilty of traffic accidents and sentenced him to 1 year and 4 months in prison.

Revise

　　After the judgment of the first instance, Wu Shuang filed an appeal.

On March 20, 2018, the Tangshan Intermediate People's Court rejected the appeal and upheld the original judgment.

Wu Shuang later filed a complaint with the Higher People's Court of Hebei Province.

On March 29, 2019, the Hebei Provincial Higher People's Court instructed the Tangshan Intermediate People's Court to form a separate collegiate panel to retrial the case.

　　In early January this year, the Tangshan Intermediate Court retrialed the case.

　　After nearly a year of waiting, on the morning of December 25, Wu Shuang received a call from the Tangshan Intermediate Court. The other party told him to come to get the judgment, but did not say the specific content.

In the Tangshan Intermediate Court, Wu Shuang saw the long-awaited verdict of innocence.

　　In the three years since he was released from prison, Wu Shuang made a living by doing odd jobs on construction sites.

After the accident, his driver's license was revoked.

He said that the truck that was purchased for 180,000 yuan broke down because it was left idle for too long.

　　If the driver's license can be restored, he plans to continue driving the truck.

Before the accident, he had been a truck driver for twelve or three years. Apart from driving and doing physical work, he said he would not do anything else.

　　In the past three years, Wu Shuang often dreamed of that night and life in prison, "This shadow (in the prison) may not be eliminated for a lifetime."

　　The surveillance video of Woluogu Middle School showed that between Zhang Chunhua and Li Yong, a total of 4 vehicles passed through this section of the road, and one of them had not been found.

The car that passed by 1 minute earlier than Li Yong is still a mystery.
