The Return of the "Dead"

  When Guo, who had been "disappeared" years later, reappeared on the streets of Tianjin, both his family, the street office and the police station were shocked.

Because as early as ten years ago, Guo's wife had applied to the Hongqiao District Court to declare Guo's death.

  Mr. Guo lives in Hebei Street, Hongqiao District, Tianjin, and once worked in the Environmental Sanitation Bureau of Hongqiao District.

Twenty years ago, Mr. Guo ran away from home and left his family without saying goodbye after handling a suspended job stay at the Environmental Sanitation Bureau.

There has been no news since then.

This time he moved back to his hometown, and the changes in Tianjin have made him unable to find a way home. Guo, with inconvenient legs and feet, wanders on the streets, and is finally sent to a nursing home by Santiaoshi Street.

  "When we saw him, the situation was really'horrible'. He said he came from Xianghe, Hebei." Qiu Xiangchen, director of the Public Management Office of the Santiaoshi Street Office, Hongqiao District, Tianjin, told a reporter from Chinanews.com At that time, he was living on the street, and then the residents called the police. The police station called the street after receiving it, saying that the people in difficulty had no place to live.

In order to help him recover, the street office temporarily placed him in a nursing home, and all expenses were paid by the street.

  Zhang Yanzhe, deputy director of the Santiaoshi police station in Hongqiao District, Tianjin and captain of the community police team, told reporters that the police station received a police report in December 2019, and a person fell on the side of the road at the gate of the Pearl of the Orient.

The police asked about Guo's name in the past.

Guo only vaguely remembered that he used to live in Hebei Street.

  "We have checked the relevant materials provided by the original account cancellation, and learned that his family filed a lawsuit in the court and declared his death. Guo Mou was reported as missing in July 2001 and was declared dead on July 1, 2010. Later, the police station handled it. The account was cancelled.” Zhang Yanzhe said, through a bit of clues, the police station found his family after several rounds.

  But then Guo left without saying goodbye, and he hadn't taken care of his family for twenty years. The family thought he was no longer alive.

Now his "resurrection" is difficult for his family to accept, and at first they even refused to meet.

In addition, during the epidemic, nursing homes were not allowed to enter casually, and there was some delay during this period.

The police station has done a lot of work for this. On the one hand, it can help his family to cooperate and help him restore his identity.

When the reporter mentioned the issue about his family, Mr. Guo pondered for a long time and lowered his head. He only said that he had missed his family a lot over the years and his son was only a junior high school student the year he left.

"Dead" and resurrected

  It is an ancient year, but was "declared dead". Guo wanted to restore his identity, but the problem was not so simple.

  "There have been people who died in a field after leaving home before, but this is the first time for Guo." Zhang Yanzhe, deputy director of the Santiaoshi Police Station in Hongqiao District, Tianjin and captain of the community police team, said that he was the first in his career. I encountered this situation this time, and it was especially difficult for the family members to not support and cooperate; because Guo’s wife was now an "ex-wife", and now his family life is very peaceful, and now he has come back from death. It's really hard to accept.

  To help Guo regain his identity, he must obtain the 100% cooperation of his family members and solve it on this basis. Therefore, probating his "ex-wife" is the most important work done by police stations, sub-district offices and other units.

From the end of December 2019 to the present, coupled with the epidemic during the period, it took a long time to do family work.

  According to Guo's family members' disclosures and speculations, Guo used to be favored at home and suffered less setbacks. Later, when working in the Environmental Sanitation Bureau, he seemed to have a small dissatisfaction at work. He could not stand it, so he left without saying goodbye, but he himself There is no contradiction with the family. It is estimated that he wants to go to another place to make more money by himself, but it seems that he is not ideal, and he feels that he has no face to face his family.

  Now that Guo is more than ancient, he has returned to his hometown, but he has the identity of a "dead".

How to help him "dead" to come back to life has become a difficult task.

  First of all, in 2010, the court made a death sentence. After that, Guo's household registration was cancelled. The first-generation ID card he carried when he left home was also lost when he was away, and he lacked legal documents to prove his identity.

  Secondly, because Guo was declared dead by a court decision, the police station could not take the initiative to restore Guo's household registration information, and it was also difficult to issue a certificate that the found "Guo" and the "Guo" who had their household registration cancelled were the same person, resulting in Guo's restoration of identity There is a risk of insufficient evidence, and then there are obstacles to the qualification review of the subject of the case.

  However, after returning to his hometown, Guo was temporarily placed in a nursing home as a homeless person. He was financially distressed, physically sick, and unable to hold a pen stably for a long time to write. He urgently needs to regain his identity for normal life.

The green channel retrieves "identity"

  In the face of difficult problems, the street office and the police station have committed difficulties. To restore their identity, they still need to go through legal procedures. Therefore, the street office appealed to the court for help.

  At the coordination meeting on the restoration of the identity of vagrants and beggars held by the police station, sub-district offices and courts, Ren Wandai, a judge of the First Civil Division of the Hongqiao Court, learned about Guo's situation, and after several rounds of discussion and coordination, he gave a solution. : The sub-district office will contact Guo's relatives to determine the opinions of their relatives, and if their relatives have no dispute over Guo's identity information, simplify the process, and use the original household registration information retained in the original death case file as Guo's The identity certificate of Guo was used to file a case to apply for revocation of death declaration, and to provide him with "one-stop" judicial services. The case was opened on the same day, the court opened on the same day, and the sentence was pronounced on the same day.

  At 3:40 pm on December 16, Mr. Guo, accompanied by his relatives, police station and street staff, arrived at the Hongqiao Court for filing the case.

Since Guo was no longer able to write, the staff compiled a written application according to his oral content, and submitted it to the case filing window together with the identity materials retained in the original file. The filing staff immediately opened the case.

  Twenty minutes later, in the 24th court, the case opened for trial.

Judge Ren Wandai conducted an inquiry and investigation of his relatives in the court trial and then pronounced the verdict in court, revoking the original death sentence, and served the civil verdict to Guo on the spot, fixed at 4:30 in the afternoon.

  With the cooperation of various departments of the Hongqiao Court of Tianjin, Guo, who had been away from home for twenty years, finally recovered his "identity" after just fifty minutes.

Currently, the procedures for re-application of Guo's household registration are being expedited.
