The trial found that in November 2018, the defendant Lin Jiancai lived with the victim Xu Moujia (female), and later Xu Moujia took his son and the victim Xu Mouyi (male, died two years and four months) with Lin Jiancai life.
During this period, Lin Jiancai often punished Xu and beat Xu.

At about 22:00 on June 24, 2019, Lin Jianshe returned to his temporary residence after drinking, using cutting boards, spatulas and other tools to hit Xu Mojia and Xu Moyi on the head, and then stepped and kicked and threw Xu heavily. Some B drowned Xu Mouyi in the washbasin and poured white wine into his mouth, which eventually led to the death of the victim Xu Mouyi, and Xu Moujia was slightly injured in second grade.
Lin Jianma is 31 years old, has a high school education and is unemployed.
He was criminally detained by the Weiyang Branch of the Xi'an Public Security Bureau on June 26, 2019 on suspicion of intentional homicide. On July 9 of the same year, he was arrested with the approval of the People’s Procuratorate of Weiyang District, Xi’an, and the next day was arrested by the Weiyang Branch of the Xi’an Public Security Bureau.
The Xi’an Intermediate People’s Court held that the defendant Lin Jiancai used cruel methods to kill the victim Xu Mouyi after drunk only because of trivial matters in life. The nature of the crime was particularly bad and the consequences were particularly serious. Therefore, the defendant Lin Jiancai was sentenced to death for intentional homicide. , Deprived of political rights for life.
