The prefect of Bouches-du-Rhône officially extended on Saturday to the entire department the curfew which targeted only the municipalities of the Aix-Marseille-Provence metropolis, de facto canceling the judicial victory obtained the same day by three small municipalities of the department against a previous decree.

Following an appeal for interim relief, the town halls of Cornillon-Confoux, Mimet and Saint-Marc Jaumegarde, as well as two residents of the municipalities of Grans and La Ciotat, in fact obtained the suspension by the administrative court on Saturday morning. of Marseille of the prefectural decree of October 17 which had established the curfew for the 90 municipalities of the metropolis of Aix-Marseille including theirs.

Attack on fundamental freedoms

In its order, the administrative court ruled in favor of the applicants, considering that this order applied "without distinction to all the municipalities of the metropolis" without these having been referred to according to "crossed criteria such as for example the density of the municipality, its incidence rate or its equipment rate.

Consequently, the applicants were “justified in arguing” that this decree “clearly violated fundamental freedoms” to come and go and to trade and industry, the court concluded.

Despite this decision, no late Saturday evening at the restaurant or in the cafes of these small towns of respectively 1,300, 1,400 and 4,600 inhabitants.

A victory without effect

This victory before administrative justice is ultimately without effect, the new prefectural decree having an even larger perimeter than the metropolis and therefore once again establishing a curfew in these towns.

Contacted Me Sylvain Carmier, who had represented the three applicant municipalities on Friday at the hearing before the administrative court, clarified that he was already preparing a new appeal for interim relief against the new decree, considering that "the Prefect ignores the judge's decision by still not taking into account the specificities of small rural communities".

An increasingly extensive curfew
