In 2006, the Inner Mongolia Higher People's Court ruled that Zhuang Yonghua's death sentence was suspended for two years.

  However, after six years in prison, Zhuang Yonghua issued critical illness certificates in violation of regulations, handled medical parole and temporary execution outside prison, and walked out of prison.

This is another case of illegal medical parole after the Inner Mongolian man Batumeng and "serving his sentence on paper".

  At the end of September this year, the reporter visited Xilinhot, Hohhot and other places, trying to restore the operation process of Zhuang Yonghua from a suspended prisoner to execution outside prison.

According to the doctor who issued a critical illness certificate for Zhuang Yonghua in violation of the regulations, he issued a certificate of violation because he couldn't bear Zhuang Yonghua's "trouble".

Five other prison doctors are also involved.

  In July last year, Zhuang Yonghua, who had lived outside the prison for nearly six years, was re-incarcerated.

The Hohhot Intermediate People's Court ruled that Zhuang Yonghua used illegal means to temporarily execute his sentence outside prison, and his two years and four months of execution outside prison shall not be counted as the execution sentence.

The five prison doctors who helped him illegally operate the procedures for medical treatment on bail were also sentenced for abuse of power.

  Shoot the rival

  In 2004, ten days after his disappearance, the 37-year-old real estate company general manager Wu Yueliang was found by the police. He died in his black red flag car.

The car rolled into a stone pit more than four meters deep in the southern suburbs ten kilometers away from downtown Xilinhot.

He was burned beyond recognition along with the car.

The police and his family only identified him through the unburned license plate and two sets of keys.

  The police quickly classified the case as a criminal case, and after investigation, they targeted Zhuang Yonghua, a native of Xilinhot City.

  This man born in 1953 is very famous in the local area.

Before the incident, he was the deputy general manager of Wu Yueliang's company, and he was better known as the husband of Zhang Yuzhi, then deputy secretary of the Xilinhot Municipal Party Committee.

  People familiar with Zhuang recalled that he had worked at the Xilin Gol League TV University and was the captain of the league committee team. He made money from smuggling cars and resigned to do business.

  Wu Yueliang's brother and chairman of the real estate company Wu Yuedong knew Zhuang Yonghua as early as 1997. He thinks that Zhuang is lustful and gambling, and his life style is chaotic, so he is not optimistic about him.

  However, in 2001, Zhang Yuzhi, then deputy mayor of Xilinhot City, commissioned and recommended him, hoping that he would arrange a job for Zhuang Yonghua.

Wu Yuedong said that at that time, he undertook the work of building a building for Xilinhot City Government. Deputy Mayor Zhang Yuzhi was in charge of finances and was responsible for signing the approval.

Wu Yuedong also hoped that Zhang Yuzhi would facilitate him in approving the money, so he recruited Zhuang Yonghua into the company.

  Because Zhuang's life circle in Xilinhot was chaotic, Wu Yuedong took him to the company in Erlianhot.

He is honored as Vice President Zhuang Yonghua to the outside world. In fact, he has no real power and does not receive wages. He only occasionally pays some pocket money to the company.

"It's'mixing' in the company." Wu Yuedong said.

  In his impression, after only one or two years, Zhuang Yonghua provoked the local powerful people because of his life style.

In May 2004, Wu Yuedong transferred him back to Xilinhot to assist his brother Wu Yueliang in work.

  But Wu Yuedong did not expect that Zhuang Yonghua, who returned to Xilinhot, fell in love with his younger brother's female secretary.

In order to please the female secretary, Zhuang also used the company's 100,000 yuan to help her decorate the house.

Wu Yueliang also liked this female secretary, "Zhuang Yonghua may have been murderous because of this." Wu Yuedong guessed.

  At 7pm on September 25, 2004, Wu Yueliang disappeared after being called out by Zhuang Yonghua.

Wu Yuedong said that during those few days, his family searched all the places they could find in the city. Zhuang Yonghua also drove to help find people after busying himself, and accompanied him to the Xilinhot City Public Security Bureau to report to the police.

It was not until the tenth day that Wu Yueliang disappeared that his body and vehicle were found in the southern suburbs.

  Sentenced to death

  The police quickly discovered the breakthrough: the small-caliber gun that killed Wu Yueliang was owned by Zhuang Yonghua. "Many people have seen that gun. He usually puts it in the car and goes to the grassland to hunt prey." Wu Yuedong said.

Wu Yueliang's last two calls were also made to Zhuang.

On January 26, 2005, Zhuang Yonghua was criminally detained by the Xilinhot City Public Security Bureau. After interrogation, he confessed to the murder.

  On March 13, 2006, the decision of the Xilin Gol League Intermediate People’s Court recorded the details of the case: Zhuang Yonghua deceived Wu Yueliang on the grounds of finding a "master of abilities" and drove him to a stone one kilometer east of National Highway 207 On the mountain.

After the two had a dispute over the female secretary, Zhuang took out the small-caliber gun in his handbag and fired at Wu, then pushed the car into the pit, saw the car emitting white smoke and fled the scene.

  After the case was solved, the scandal spread to everyone.

At that time, Zhuang Yonghua's wife Zhang Yuzhi had already served as deputy secretary of the municipal party committee.

A person familiar with Zhang Yuzhi said that she soon resigned from her post and left Xilinhot.

Wu Yuedong remembered that Zhang Yuzhi had called him, "She said that Lao Zhuang's crime was deserved, and she waited for the court's judgment to make the compensation as it should be."

  At the end of September this year, Zhang Yuzhi told a reporter from the Beijing News that the things Zhuang Yonghua committed that year hurt her a lot, and she still feels uncomfortable talking about it.

"Over the years, I don't care about him, but I can't ask."

  On August 2, 2005, the Intermediate People’s Court of the Xilin Gol League of the Inner Mongolia Autonomous Region made a first-instance verdict on the case. Zhuang Yonghua was sentenced to death for intentional murder and illegal possession of firearms.

  Zhuang Yonghua refused to accept and lodged an appeal.

On December 14, 2005, the Higher People's Court of the Inner Mongolia Autonomous Region sent the case back to the Xilin Gol League Intermediate Court for a new trial on the grounds of "unclear facts".

  On February 27, 2006, the case was retrial in Ximeng Intermediate Court.

"Zhuang Yonghua did not plead guilty in court," recalled Wu Yuedong who participated in the observation. Zhuang Yonghua argued in court that there was no evidence to prove that he shot Wu Yueliang with a gun. The previous guilty confession was extorted by torture and there was no fact of intentional murder. He was acquitted.

  However, the Intermediate People's Court did not adopt Zhuang Yonghua's defense opinions.

On March 13, 2006, the court ruled that Zhuang Yonghua used cruel methods to cause Wu Yueliang’s death, which was of very bad nature, and again decided to execute the death penalty on Zhuang Yonghua, depriving him of political rights for life.

  Zhuang Yonghua appealed again.

On November 16, 2006, the Higher People’s Court of the Inner Mongolia Autonomous Region revoked the sentence of the original sentence and commuted the sentence to Zhuang Yonghua’s death sentence, suspended for two years, and deprived of political rights for life.

On January 6, 2007, Zhuang Yonghua entered the Hohhot No. 1 Prison to serve his sentence.

  Three reductions

  Zhuang Yonghua received a reduced sentence soon after being imprisoned.

In three years, he was executed three times.

  The first commutation was in April 2009, the second year Zhuang Yonghua served his sentence.

The penalty change ruling published by the China Judgment Documents Network in June this year shows that the Higher People’s Court of the Inner Mongolia Autonomous Region ruled to reduce his death to 18 years in prison. The sentence will start on December 28, 2008 and end on December 27, 2026. , The period of deprivation of political rights was changed from life to 6 years.

  "Before the "Criminal Law Amendment (8)" in 2011, Article 50 of my country's "Criminal Law" stipulated that if the death sentence was suspended, if there is no intentional crime during the suspended execution period, the sentence will be reduced to life imprisonment after the two-year term expires. ; If there is a significant performance, after the expiration of the two-year period, the sentence will be reduced to 15 years or more but not more than 20 years in prison." Shu Honghui, a professor at the National Security College of Northwest University of Political Science and Law, explained.

  This means that if Zhuang Yonghua’s commutation complies with the regulations, he has performed significant meritorious service during the suspended execution period.

But the ruling did not mention the reason for the reduction of sentence.

  According to a report by The Paper on September 7, Wang Hongyun, a prisoner serving sentence with Zhuang Yonghua in Hohhot No. 1 Prison, was found to have purchased a patent in 2008 but has not been investigated in depth.

In 2009, Wang purchased three utility model patents to reduce his sentence.

The report also mentioned that Zhuang Yonghua also applied for a patent.

  According to the official website of the National Patent Office, from 2005 to 2010, there were nearly ten patents filed under the name "Zhuang Yonghua", of which five patents involved medicine, industry and other fields. "Chuanwan", "Household Floor Heating Boiler", etc., the address of the applicant is "2001 Mailbox Education Division, Hohhot, Inner Mongolia Autonomous Region", which is suspected to be the mailing address of Hohhot No. 1 Prison.

However, Zhuang Yonghua did not respond to whether the sentence was commuted because of the patent.

  In the following two years, Zhuang Yonghua was commuted twice.

  In October 2010, the Hohhot Intermediate People’s Court ruled that his sentence was commuted by 3 years, and the sentence will expire on December 27, 2023, and the deprivation of political rights will remain unchanged for 6 years; in May 2012, Zhuang Yonghua was again commuted by the Intermediate People’s Court by 2 years6 The release date will be adjusted to June 27, 2021, and the deprivation of political rights will remain unchanged for 6 years.

  Five prison doctors illegally operate on bail for medical treatment

  In February 2013, Zhuang Yonghua was allowed to seek medical treatment on parole for 6 months before leaving the prison.

After that, he was renewed twice in a row until August 24, 2015, when he was granted temporary execution outside prison and continued to live outside the prison.

  In 2019, Zhuang Yonghua's medical parole was confirmed to be an illegal operation.

Five prison doctors including the deputy warden of Hohhot Fourth Prison of Inner Mongolia, Wang Quanren, deputy director of the First Hospital of Inner Mongolia Prison Administration Bureau, and Gao Chuntao, director of the Department of Internal Medicine of the First Hospital of Inner Mongolia Prison Administration Bureau, were involved and suspected of making a false critical diagnosis for Zhuang Yonghua , To help him see a doctor on parole in violation of regulations.

  On April 1 this year, the People’s Court of Naiman Banner, Inner Mongolia Autonomous Region, announced the first-instance verdict on the crime of abuse of power by five prison doctors.

The details announced in the judgment show that from December 2012 to February 2013, before Zhuang Yonghua went to the hospital on medical parole, he was hospitalized due to illness at the First Hospital of the Inner Mongolia Prison Administration.

In January 2013, Gao Chuntao, the director of the internal medicine department of the hospital, issued the "Report on Critical Illness of the Petitioned Criminal" to Zhuang Yonghua, and diagnosed Zhuang as suffering from bronchial asthma complicated infection (severe) and primary hypertension level 3 (very high-risk group) , Coronary heart disease-arrhythmia, frequent junctional escapes, occasional premature atrial, occasional early ventricular, sinusitis, liver cysts and many other diseases.

  The "Report" also mentioned that "patients have been hospitalized for many times, with frequent attacks during the hospitalization period, and poor efficacy. The current condition worsens again and may die due to respiratory failure at any time. The report is critically ill." Subsequently, Gao Chuntao, the Inner Mongolia Prison Administration Bureau Chen Hua, chief physician of the emergency department of a hospital, and others confirmed their signatures in the "Department Appraisal Team Opinion" column of the report.

Wang Quanren signed and signed the opinion that “the situation is true” in the “Opinions of the First Hospital” column of the report.

  On the same day, Wang Quanren presided over a meeting of the Prison Bureau Hospital’s medical treatment appraisal group meeting. After research, he agreed with the medical diagnosis and found that he met the conditions for medical treatment. He also issued the "Convicts Medical Condition Appraisal Opinions".

After the first prison reported to the Prison Administration Bureau for review and approval, on February 4, 2013, Zhuang Yonghua was granted the first medical parole for 6 months.

  When the first medical parole was about to expire, Zhang Man, the former director of the Preventive Health Department of the First Hospital of the Inner Mongolia Prison Administration Bureau, and others violated the regulations to renew his insurance.

  At that time, several doctors from the Medical Affairs Department of the First Hospital of the Inner Mongolia Prison Administration inspected Zhuang Yonghua’s condition and hospitalization. Subsequently, Zhang Man, the former director of the Preventive Health Department, and others issued a diagnosis of the Critical Condition of the Criminal Petition for Zhuang Yonghua. Prove that the patient's condition is critical and his life is in danger at any time.

  Afterwards, Zhang Man and Li Qifang, the former physician of the First Hospital of the Inner Mongolia Prison Administration Bureau, signed the diagnosis certificate, confirming that Zhuang Yonghua was in serious condition, and Wang Quanren signed the opinion that the situation is true.

A month later, Wang Quanren issued Zhuang Yonghua the "Appraisal Opinions on the Condition of the Offender for Medical Treatment on Parole" and renewed his insurance for one year.

  In August 2014, with the help of Gao Chuntao, Wang Quanren and others, Zhuang Yonghua applied for a second one-year renewal.

  According to the notice issued by the Ministry of Justice, the Supreme People’s Procuratorate, and the Ministry of Public Security on the “Enforcement Measures for Medical Parole for Offenders”, prisoners who suffer from serious diseases and are in danger of death in a short time, or who are physically disabled or sickly elderly can be parole for medical treatment.

However, the expert opinion on Zhuang Yonghua’s condition submitted by the Inner Mongolia Autonomous Region Health Commission to the court confirmed that Zhuang Yonghua’s illness did not reach life-threatening levels from 2012 to 2015.

  Facing the court trial, Wang Quanren also admitted that because of his lax checks, he accepted the property of Zhuang Yonghua’s relatives, and there was a problem of signing by non-identification team members in Zhuang’s critical illness report.

  "Unqualified" critical illness certificate

  During the period of medical parole, Zhuang Yonghua almost never appeared in public.

Wu Yuedong never met Zhuang Yonghua again, but he later heard that a friend met the Zhuang family in Hainan and exchanged greetings with each other.

"My friend said Lao Zhuang was in good health." Wu Yuedong recalled, "I let him out without knowing why."

  In addition to the five prison doctors, doctors from the Xilin Gol Military Division Hospital and the Xilin Gol League Mongolian Medical Hospital also issued critical illness notices for Zhuang Yonghua in violation of regulations.

  At the end of 2013, Zhuang Yonghua was receiving treatment at the Xilin Gol Military Sub-district Hospital when he applied for the first time to renew his insurance.

Sui, who was the director of the Xilin Gol Military Division Hospital at the time, proved to the court that the medical records of the former Military Division Hospital were lost during the transfer of the army in 2017, but Zhuang Yonghua’s two critical illness reports were from a doctor surnamed Li. hand.

  The doctor surnamed Li also explained to the court that Zhuang Yonghua's condition suddenly worsened in July 2013 and became critically ill, but his condition improved and was discharged three days later.

The doctor surnamed Li believed that Zhuang's condition was not serious, but he still issued a critical illness notice and a diagnosis certificate for him.

  At the end of September this year, a reporter from the Beijing News learned locally that the military sub-district hospital had closed business. The original doctors and nurses had gone to other hospitals and could not find a doctor surnamed Li.

  In 2014, when the insurance was renewed for the second time, Zhuang Yonghua was hospitalized at the Xilingol League Mongolian Medical Hospital due to illness.

The then attending doctor Li Yunfeng issued "critical illness notices" to Zhuang Yonghua twice.

On September 21, Li Yunfeng confessed to reporters that Zhuang Yonghua's condition did not meet the critical condition.

  Li Yunfeng is the director of the Department of General Medicine at the Mongolian Medical Hospital of Xilinguole League. Between 2014 and 2015, Zhuang Yonghua was admitted to the hospital twice, the first time he stayed in the general medicine department, which is now the general medicine department, and the second time he was admitted to the respiratory department. Transferred to comprehensive internal medicine.

In his impression, Zhuang Yonghua did experience sweating, irritability and other symptoms when he was first admitted to the hospital. He was diagnosed with bronchial asthma and heart problems.

"But no serious problem was found." Li Yunfeng recalled.

  However, Zhuang Yonghua did not leave the hospital, always shouting uncomfortable, saying that his chest hurts for a while, and then he was holding his breath, and then he called for medical staff.

After doing a lot of inspections, the problem could not be found. "He is not forgiving and we don't know what to do." Li Yunfeng said.

  Zhuang Yonghua's eldest daughter Zhuang Liang (a pseudonym) also caused him a headache.

Zhuang Liang now works in the Legal Brigade of the Xilinhot Public Security Bureau. At the end of September, the reporter learned from the Xilin Public Security Bureau that Zhuang Liang had been seconded to other departments.

  When Zhuang Yonghua was hospitalized, Zhuang Liang found Li Yunfeng many times and proposed to take Zhuang Yonghua to see a doctor outside.

But the prerequisite for transfer is that Li Yunfeng should issue a critical illness notice.

  On September 21, Li Yunfeng explained to the Beijing News reporter that they did not know that Zhuang Yonghua was a "special" patient, nor did they understand the transfer policy of prisoners in prison.

There were no prison policemen or doctors from the First Hospital of the Prison Bureau to understand Zhuang's condition and treatment.

"If someone tells us in advance that patients like Zhuang Yonghua should pay special attention and need to be transferred before being transferred, we will also have the bottom line."

  But at that time, they felt that Zhuang Yonghua was "making trouble". As for why he was "making trouble", the doctors did not know.

Li Yunfeng said that in the end, because he couldn't help but toss, he issued a critical illness certificate to Zhuang Yonghua, "Let him'turn away'."

  After Zhuang Yonghua was put in prison again, Li Yunfeng was also required to cooperate in the investigation for suspicion of issuing a critical illness certificate in violation of regulations.

However, Siqinbaatar, the director of the Mongolian Medical Hospital and Bai Chaolu, the vice-president of the Mongolian Medical Hospital, both stated that they were unaware of the critical illness notification issued by the hospital to Zhuang Yonghua.

  On August 24, 2015, Zhuang Yonghua was approved for temporary execution outside prison.

It was not until July 19 last year that Zhuang Yonghua was put into prison for execution.

On October 24, 2019, the Hohhot Intermediate People's Court issued a criminal ruling on penalty change, and the two years during which Zhuang Yonghua was temporarily sentenced outside prison will not be counted as the execution sentence.

  In April of this year, five prison doctors including Wang Quanren and Gao Chuntao, who participated in handling procedures for Zhuang Yonghua’s illegal medical treatment outside the parole, also accepted the court trial.

In addition to Zhuang Yonghua, they also handled violations of the regulations for medical treatment for two other prisoners.

The Naiman Banner People’s Court found that they violated the laws, regulations and rules related to the medical condition evaluation of criminals on parole, and the five were sentenced to five years and six months to three years in prison.
