The People’s Court of Wuhua District, Kunming City, Yunnan Province sentenced him to one year’s imprisonment. At the same time, he was prohibited from engaging in education, training, nursing and other occupations related to minors within 3 years from the date of execution of the sentence or release on parole.

This is the first time that the Wuhua Court has made a "prohibition of minors' protection and practice" in accordance with the "Criminal Law Amendment (9)".

  In May of this year, 17-year-old Xiaoli (pseudonym) was in the sprint stage of her senior year. In order to improve her grades, she came to a private training school in Kunming to study.

Because my family is not in Kunming, the training school provides accommodation. After understanding, Xiaoli's family agreed to live in the dormitory arranged by the training school to facilitate study and life.

  Chen Moumou is the school management teacher of this private training school. He is usually responsible for naming and supervising the students to complete the administrative tasks such as learning tasks.

One day in May, the students in the same dormitory with Xiaoli did not live in the dormitory because of the physical examination. There was only Xiaoli in the dormitory.

At 4 in the morning, when Xiaoli was asleep, Chen Moumou suddenly entered Xiaoli's room to "chat" with her.

During the period, Chen Moumou took out her mobile phone to take pictures of her, touched her head and hugged her waist, saying that she had a good impression of her.

Xiaoli's parents were very angry and called the police immediately.

  The Wuhua District Procuratorate filed a public prosecution against Chen XX for the crime of compulsory indecency, and the defendant in the court had no opinion on the facts and charges brought by the prosecutors.

  After trial, the Wuhua Court held that Chen XX’s behavior constituted the crime of compulsory indecency.

According to one of the 37th article added to the "Criminal Law Amendment (9)" promulgated in 2015: "Whoever is sentenced to a criminal penalty for committing a crime by using his position to facilitate a crime or committing a crime that violates professional requirements, the people's court may According to the circumstances of the crime and the need to prevent further crimes, they are prohibited from engaging in relevant occupations from the date of execution of the sentence or the date of parole for a period of three to five years.” Accordingly, in order to effectively protect the rights and interests of minors, except for the defendant Chen Moumou was sentenced to one year’s imprisonment, and an employment prohibition order was issued to him, which would prohibit him from engaging in education, training, nursing and other occupations related to minors. The prohibition order could isolate Chen Moumou from the future. Adult contact inhibits the possibility of re-offending.

  The trial judge in this case suggested that minors should strengthen their awareness of sexual assault and protect themselves. When minors are sexually assaulted, they will fall into a state of panic and helplessness. With a deep sense of shame and humiliation, most of them remain silent, which encourages the arrogance of the sexual assailant.
