The coronavirus will invite itself to the industrial tribunal.

An employee was indeed dismissed for “serious misconduct” in Mulhouse, in the Haut-Rhin, because he had returned to work after having passed a Covid-19 test which turned out to be positive.

A test on July 16

On July 14, Sébastien Klem returned from Biarritz with his 4-year-old daughter and resumed his job at the HLM office in Mulhouse.

According to him, he only had a small cough at the time but no other symptoms.

Two days later, he said by chance, passing near a Covid screening drive where there was no waiting, that he decided to be tested.

Then he returned to his office.

But the same evening, Sébastien Klem was informed that his test was positive.

Immediately, he warned his employer so that measures could be taken.

The floor where he worked was closed and everyone present was asked to get tested.

Sébastien Klem was put in his fortnight with his daughter.

In mid-August this employee received a registered letter for a preliminary interview with a view to a possible dismissal, then on August 24 his dismissal letter for serious misconduct.

According to management, “he should not have returned to work after the test.

We do not do a screening if we have no suspicion ”.

, the director general of the HLM office, Eric Peter, accused his employee of having “come to work with symptoms”.
