Your Facebook account is not that private.

The Court of Cassation ruled in favor of an employer who had dismissed an employee for having published a photo on her Facebook account, reports Franceinfo, this Friday.

The story begins in 2014. An employee of the textile company, Petit Bateau, posted a photo of the future spring-summer 2015 collection on her Facebook account, allowing her friends on the social network to see it.

"The right to proof"

Except that among his Facebook friends is one of his colleagues, who informs the management.

The employee is immediately dismissed.

If we thought until now that our publications were "private", the Court of Cassation has decided otherwise.

The body considered the dismissal valid, arguing that "the right to proof" justified it.

"That is to say that to have proof that the employee had indeed disclosed confidential information, the employer was obliged to go through it, by the production of private information", explain our colleagues.

The magistrates nevertheless recognized that the employer had violated the privacy of his employee by sacking her for an image published on her Facebook account.

This decision should now set a precedent.
