  The Second People’s Court of Dongguan City in the first instance sentenced Zheng Gang and Pan Jing to 15 years and 6 months’ imprisonment and 12 years’ imprisonment for the crime of organizing and leading a triad organization, the crime of creating disturbances, and the crime of illegal detention, respectively, and confiscated them. The remaining 15 people were sentenced to imprisonment from eight years to one year and six months, and some were fined.

After the sentence was pronounced, some defendants appealed.

  The second review by the court revealed that, starting in 2013, Yu Gang and Pan Jing successively invested and established three companies. Through relatives and fellow villagers, they gathered multiple people to join the company for usury business.

Yu Gang and others first raised funds from private individuals, and then used a high monthly interest rate of about 3-10 cents to lend to small and medium-sized business operators who had difficulties in operating funds, most of which were shoe companies in Houjie Town.

In this process, a triad organization with Yu Gang as the organization and leader and Pan Jing as the organizer, with clear levels and stable backbone members, has gradually formed.

In order to ensure that the loan funds and interest can be recovered in time, the organization set up a special patrol team to closely monitor the daily operating conditions of the lending companies. Once the lending companies are found to be under-operating or on the verge of bankruptcy, they require the borrowers to pay off their debts immediately.

When the borrower was unable to pay off, Yu Gang instructed the members of the organization to take the borrower to the company or nearby hotels for detention and assault, forcing the other party to raise funds to pay off the debt.

According to statistics, the organization carried out 13 illegal detentions, one of which detained the borrower for 26 days.

In addition, the organization also used violent methods such as stalking, deliberate injury, illegal intrusion into other people’s homes, and power cuts to force others to repay. Many victims were frightened by their violence and did not dare to report or accuse them through normal channels. Leaving Houjie severely disrupted the local production and operation and social order.

  The court of second instance held that the facts ascertained in the original judgment were clear, the evidence was reliable and sufficient, the conviction was accurate, the sentencing was appropriate, and the trial procedures were legal, so it made the above ruling in accordance with the law.
