Nara Kashiba Waste Disposal Bidding Trial Decided to Dismiss City Appeal Supreme Court September 11 5:09

In a bid for a garbage collection project conducted by Kashiba City, Nara Prefecture, the Supreme Court decided to dismiss the city's appeal in a trial in which residents complained that the contractor was decided in advance and it was illegal. The ruling that ordered the contractor to return the consignment fee was finalized.

Kashiba City outsourced the household waste collection business to a contractor in the city in 2016 after a bid called "nominated proposal", but local residents said, "The bid is a contractor only by form. Is illegal because it is decided in advance. "

Both the 1st and 2nd trials said, "It seems that the contractor had decided to outsource before the contract, such as preparing a garbage truck before the bid was solicited and painting according to the contents of the solicitation. The contract is illegal, "he said, and ordered the city to ask the contractor to return the commission fees already paid and to suspend the payment to the contractor.

The city side had appealed to this, but Keiichi Hayashi, the judge of the Supreme Court's third small court, decided to dismiss the appeal by the 10th, and the city's defeat was confirmed.

In July, the Osaka District Public Prosecutor's Office is investigating this issue by searching the homes of contractors and related city council members on suspicion of violating the government-manufactured negotiation prevention law.
