■ Tracking "Human and Dog Collision Causes Disability"

  On July 31st, Chengdu chef Zhong Ke received a civil mediation letter from the People’s Court of Jinjiang District, which marked that the much-watched “human and dog collision resulting in disability” event finally ushered in the mediation result: the big dog who knocked down the clock. The owner, Ms. Xie, compensated Zhong Ke 110,000 yuan, and the little dog owner Ms. Hu, who chased and played with the big dog, compensated Zhong Ke 30,000 yuan.

  At 8 o'clock in the evening on August 17, 2019, Zhong Ke rode a battery car home from get off work. When passing near the Gaowei Park on Jinjiang Avenue, two dogs, one large and one small, chased on the road and ran all the way to Zhong Ke who was riding. Zhong Ke instinctively avoided the two dogs and then accelerated to leave, but the dogs suddenly turned back and ran towards him again. After riding away from the puppy, Zhong Ke collided with the big dog and fell and was injured.

  It was later identified that Zhong Ke's injury constituted a grade nine disability. In April of this year, Zhong Ke commissioned a lawyer to take the big dog owner Ms. Xie and the puppy owner Ms. Hu to court, requesting the court to order the defendant to pay 346759.2 yuan in total for various economic losses. On the afternoon of June 10, the Sansheng People's Court of the People's Court of Jinjiang District of Chengdu opened a court session to hear the dispute.

  In court, the puppy owner Ms. Hu insisted that her dog had not contacted Zhong Ke and therefore should not be held responsible. Ms. Xie, the owner of the big dog, said that her salary was meager and she could not afford huge financial compensation.

  The civil mediation document issued by the People’s Court of Jinjiang District of Chengdu shows that the parties voluntarily reached the following agreement after court mediation: Defendants Ms. Xie and Ms. Hu paid the plaintiff Zhong Ke a total of 140,000 yuan for disability compensation and dependent living expenses. Ms. Xie bears 110,000 yuan, and the defendant Ms. Hu bears 30,000 yuan. The plaintiff Zhong Ke applies for compensation from the unit and the Social Security Bureau. The plaintiff Zhong Ke no longer claims against the defendants Ms. Xie and Ms. Hu, and the defendant Ms. Xie, Ms. Hu has nothing to do.

  At the same time, the mediation document stated that if the defendants Ms. Xie and Ms. Hu did not perform the contract, Zhong Ke could apply for enforcement. Zhong Ke accepts and is satisfied with the mediation result.
