The defendant, Yang Jicheng, the former chief of the Administrative Undertaking Audit Section of the Audit Bureau of Lin'an District, took advantage of his position to illegally accept a huge amount of more than 11.3 million yuan from others, and was sentenced to 11 years in prison and a fine of 1 million yuan.
Why can a small section chief corrupt tens of millions? What is even more puzzling is that Yang Jicheng is well-known in the Lin'an District audit system. His family runs businesses and has many land and factories. The annual rent for the factory alone is more than 2 million yuan. Friends call him "Yang Ten million". , Why did he, with a superior family background, embark on the road of corruption?
Good face pushes myself down the fire pit
Yang Jicheng, who has enjoyed the encirclement of stars and the moon since childhood, has a very good face. On weekdays, when someone needs a guarantee, he will not even want to come forward as long as he flatter a few words. In 2012, he pledged 3 million for his friend Lin Moumou as usual. But not long after the guarantee agreement was signed, Lin Moumou was detained by the public security organs for illegal fund-raising. As a guarantor, Yang Jicheng was quickly targeted by the lender. They sent people to follow Yang Jicheng to and from get off work every day, sitting in his office. Yang Jicheng, who has never suffered a setback, is full of panic, but he is good-looking and doesn't want his family to know about it.
At this moment, businessman Wang Moumou came to him. Wang Moumou is the local engineering boss in Lin'an. Yang Jicheng had "aided" during the project audit before. To express his gratitude, Wang Moumou specially offered one million yuan. Excited, shocked, scared... But in the end, Yang Jicheng chose to accept the money.
"I really needed this money at the time. Those people followed me all day, and I wanted to get rid of them too much." Yang Jicheng used the money to solve the immediate trouble, but it was tantamount to drinking poison to quench thirst. He pushed into an even more terrifying abyss.
Crazy money-gathering to solve economic difficulties
Although Yang Jicheng's position is small, his power is not small. Yang Jicheng has worked in the audit system for 25 years, especially after serving as the director of the audit center, he can directly influence the audit work of government-invested construction projects of millions, tens of millions, and even hundreds of millions.
The settlement review report is an important basis for the project owner's settlement. And Yang Jicheng holds such a core power. Whether the project cost is reduced and the order of the audit are closely related to the interests of the project owner, and even the length of the audit time will affect the project owner's financial cost.
In 2014, many funds lent or guaranteed by Yang Jicheng could not be recovered, and most of these funds were borrowed from banks. There are calls for reminders every day, and Yang Jicheng has to transfer loans between banks, planning how to plug the funds hole all day long.
It was this year that the urban construction intensity and scale of Lin'an District, Hangzhou City continued to increase, and many project owners were looking for Yang Jicheng. Yang Jicheng deliberately or unconsciously revealed his financial shortage, the construction was convenient and he understood, and he gave out a lot of cash to Yang Jicheng. Sometimes when urged by dunning, Yang Jicheng will also take the initiative to mention the benefit fee. In 2014 alone, Yan Kee made a frenzy of more than 4 million yuan, of which the highest bribe was 1.8 million yuan.
In an eagerness to recover losses, in 2014, Yang Jicheng raised a lot of funds to invest in futures trading, hoping to recover from the huge returns of futures trading. He is like a gambler, he will go to the futures account once he has money, but as a result, not only the money is not made, but the huge debt is increased. From 2014 to 2018, Yang Jicheng's loss in futures trading reached more than 15 million yuan. Such a shortfall cannot be made up for with his meager salary income. As a result, Yang Ji decided to grab money from his clients, accumulating tens of millions of bribes.
Resignation is hard to escape punishment
Behind the madness, Yang Jicheng also has a cautious side.
He is highly vigilant and rarely shows up when accepting bribes. Even if he shows up, he is in closed or semi-closed places such as homes and coffee shops. In 2014, Chen, the project manager of a large residential community, used two plastic boxes to pack 1.8 million yuan in cash and gave it to Yang Jicheng in order to seek help in the project audit. Yang Jicheng borrowed unlicensed vehicles from friends and asked familiar auto repair shop workers to accept the huge sum of money. After receiving the two plastic boxes containing 1.8 million yuan in cash, in order to destroy the evidence, Yang Jicheng specially discarded the box and the lid separately.
In January 2019, Yang Jicheng knew that he was unable to save the situation, so he resigned from the Audit Bureau in an attempt to avoid criminal responsibility. However, even the cunning fox can't beat a good hunter. In September last year, the Commission for Discipline Inspection of Lin'an District, Hangzhou City adopted a lien on it.
The investigation found that Yang Jicheng received bribes 25 times, with the amount exceeding 10 million yuan, of which 4 times the amount of bribes exceeded 1 million yuan. His corruption seems to be a chain reaction triggered by guarantees, but it is actually the inevitable result of his disregard of party discipline and state laws.
The system problems exposed in this "small officials and huge corruption" case are worthy of deep consideration. For posts such as the director of the audit center that can be finalized, regular rotations should be implemented, and the discretionary power should be strengthened oversight and checks and balances. After the case occurred, the Commission for Discipline Inspection of Lin'an District of Hangzhou City issued a supervisory recommendation to the District Audit Bureau, asking for inferences and comprehensive rectification, building a "non-corrupt" system cage, and fundamentally eradicating the breeding ground for corruption.
